We wre at the court house but noone was helpful there, she read the documentation and saw that the case gets looked at at least after 90 days of petition. She was too upset and I said we should go home. 

 

I don't even know how to handle this and I can't leave until smething's in the works.

She is lying.

 

I don't think Y iu get how it works. You can leave and file a divorce from anywhere...print it gr8 the internet and mail it in!!!!

 

Geezeeee just leave already Y iu obviously aren't happy here or with her

Well I was together with her, I did see that myself and it's true, you file the divorce and there's a cool off period of 90 days after which the court takes the case. I won't be here for that so I read that she'll have to mail me the papers, I'll sign them in my country with a creddited attorney and mail them back. I just won't be there to contest anything, which I really hope there's anything to contest in the first place.

You can leave when you want, she can even have your marriage annuled since it has not been 6 months yet. She does not nee you for the annulment process here in the US. Seems like both of you have made your bed about what you want and further discussion would only lead to more people giving you suggestions, which has been said many times over now.

 

Your Options:

 

1. Stay, file for divorce and go back.

2. Go back and wife can file for divorce (easy to claim since your wife can state that she was abandoned by you)

3. Go back and your wife annuls the marriage.

4. Stay and learn to love this country

5. Believe in yourself that you can do wonders here and start keeping yourself busy.

One of the major reasons of being homesick in the first 6 months is when you have nothing to do and you get bored and keep thinking about your home. Once you start working, which could be in another 6 months, you wont have time to think about food let alone about being homse sick.

 

So here are your options, hope you choose wisely so you dont regret it later.

Thank you for your responce. From what I looked into we can't annul the marriage, there's certain requirements for it and being a short marriage is not one of them, neither is leaving the country.

Abandonment can only be done 1 year after I'm gone.

 

So from what I see she can either file the divorce and then she'll have to mail me the papers and I'd have to sign them in my country with the help of an accredited lawayer, I'd have to dig more for that. Or I saw that Lincoln County Court accepts divorces through mail and doesn't need us to be in court, so I'll try to suggest that.
Although, what's the easyest way to find someone to look over the documents we're gonna send, as it'll only be a one time thing and I wouldn't want to mess it up.

Theres nothing to contest.  Its not like a marriage over which you have accumulated things, savings, etc...  your soon to be ex wife has a right to be angry and upset.  You have a right to leave a marriage you are not happy in or a place you do not think you will ever grow to like.

You can start the divorce if you want. Contact a US lawyer and figure it out.  This is no longer an immigration issue.
