I don't like the tone of people here. If someone is not good with papers, you treat them as thieves and criminals. Once I get my papers right, will I be a good person in your eyes. You guys need a medal for following the rules? Wake up.

I think you need to broaden your views for your own good. One, even if I am kicked out of this country I am and still would be a millionaire. And thats cuz of my own effort, don't owe it to anyone or any country. I am not dying to be in this country, its just best thing for me at this moment. Just cuz somebody was born in some geography doesn't mean anything, atleast I don't judge that way.

The immigration system where a young 25 year old person has to wait 12-15 years to  become citizen, that system is useless according to me. I would stop caring about it. I am hyper practical person, not saying everyone should think like this.

If you are not concerned with which country you are in then why break the rules?  I assume you knew your OPT status would expire eventually and if you were not able to find another option why complicate your future status with an overstay?  As to your OP, your parents will have to state truthfully what their intentions are and in you OP you stated that was to visit you.  You do know that USCIS actively monitors sites like this right?

As an aside I was talking to a couple of Chinese guys who were here as Students and took advantage of the MAVNI programme, and were fast tracked for Citizenship, a few months they said.

Mind you it involved joining the US Military, probably not applicable in this case.

You do not like the one of people on this website?  You were granted a time to be here legally and YOU decided to abuse the system.  Then you want your parents to come.  Why, so they can stay here after their visa has run out too?  You say, you do not like the time it takes to become a citizen.  I am a US Citizen and my wife is a naturalized US citizen, going through the long and legal process to get here and we will still have to wait another 20 years to bring her sister over here.  Yet, you, an ILLEGAL immigrant are over here.

Where is the justice to that.  Go back to India and if you want to live here, do it the legal way.

India could use some hyper practical rupee millionaires. You're welcome to leave for India if you find our system useless; no one's forcing you to overstay.

When you overstay and break rules of this country, I wouldn't expect much sympathy. You're an adult who intentionally chose to abuse the rules under which you were given an F1 visa, and now looking for an option to have your parents lie to the CO/CBP to get to visit the US. Gosh!!!!

Ahhh. ILLEGAL ha. I guess people in this forum could use some education from some "GOLD" members. Learn the definition of Out of Status and Illegal first. At least for this website. No wonder Trump, has so much support in this country. I would have have voted for him too but I know where he is bullshitting.

For everyone else who's blood is boiling how can someone who is "ILLEGAL" voicing his opinion freely. Chill out. I am married to US born citizen, who was my classmate and no I did not meet her on dating website. I am not that ugly. We have a baby on the way. I am waiting for my second anniversary and then applying for Change of Status.  How I came to decision of not applying has a sound Legal and practical reasons, with legal advise from out lawyer.. So before anyone  advises me to apply asap, don't waste your efforts.

As far as parents they are very happy being in India, they just coming to see their grand child. Save your fury against immigrants for Trump rallies and cameras. Let this forum be the place where people discuss before visiting Lawyer. Man no place in the world is apolitical nowadays. People are looking for Justice on this forum . I pity you guys.

Because direction this post has taken is nowhere intended. I will further move it away.

Anyone wondering where earned my money so quickly, answer is Bitcoin. I was you can say early adopter and miner. No not cuz I was software engg, I studied Finance from a top business school. Crypto-currency has libertarian flavor so my thinking has evolved with that too. Just free advice, buy yourself small amount soon, educate yourself. And no govt cannot stop it. And by design they are global, that's why I don't care being thrown out of this country.

I don't know why I am posting this here.

Out of status (without an authorized stay) means you are unlawfully present in the country. "Illegal" is not a legal term to describe somebody's status, but generally it refers to anybody who is not legally present in the US.

First it's AOS, not COS. COS is for changing to another non-immigrant status.

Second, a lawyer told you to wait until your second anniversary to apply for AOS? Umm...why? To avoid ROC? You could apply well before 2 years and still avoid ROC. AOS is taking close to a year to complete, so applying even 6 months beforehand is pretty safe (plus to AOS from your entry status requires an interview, which you could push back). It just seems odd that an attorney would advise somebody to stay and work illegally longer than necessary (well, unless he's hoping for an NTA first to really make some extra bucks! ;) ).

Um, no you couldn’t, because you’re not a citizen.

You’re probably heading into a situation where your parents are going to be denied a visa that will make it incredibly difficult for them to ever get a visa to visit you and their granchild...but as you seem to know so much more than anyone here, I’m sure that won’t stop you.

By the way, you haven’t made your money on bitcoin till you’ve sold it, and then your profits are taxable, even if you’re illegal or out of status ...so we and the IRS do thank you for contributing to our tax pool.

Story doesn’t add up. Why would OP be complaining about a 12-15 year wait for citizenship if he’s married to a US citizen?

Exactly. Why is he even out of status if he's married?

Also, he says he isn't "dying to be in this country. It's just the best thing for now" but says he has a wife and child here. I'm sure the wife and child are thrilled to know that they are "just the best thing for now" and he's not dying to be with them. I'd not be very pleased if my husband was telling people I'm just a temporary feature in his life.
