Timeline

Hi! We are close to submitting my AOS packet and wanted to make sure we have everything for the millionth time. We've made copies of everything included as well. For reference, I'm adjusting from an out of status F1 visa. I also have questions that I'm unsure of that I'll insert at the end.

 

Form I 485: Application to Register Permanent Residence 

 

1. Money order for $1225 (filing fee for form I­485, $1140 + Biometrics fee, $85)
2. Cover letter
3. Form I­485 with 2 photographs;
4. Sealed medical examination results; 
5. Certified copy of marriage certificate;
6. Copy of alien spouse birth certificate;
7. Copies of the identification and stamped pages of Applicant’s passport;
8. Copy of the electronic I­94 upon last arrival into the US;
9. Copies of the identification, visa, and stamped pages of the beneficiary’s expired passport.

 

Form I 130: Application to Petition for Alien Relative 

 

1. Money order for $535 to cover the filing fee;
2. Form I­130 with 2 photographs each of the Petitioner and the beneficiary;
3. Form I-130A – Supplemental Information for Spouse Beneficiary
4. Form G­325A for petitioner;
5. Form G­325A for beneficiary;
6. Copy of the petitioner’s birth certificate;
7. Copy of the couple’s marriage certificate;
8. Copies of the identification and stamped pages of the beneficiary’s current passport;
9. Copies of the identification, visa, and stamped pages of applicant’s expired passport;
10. Copies of the applicant’s I­20 forms;
11. Copies of beneficiary’s 2014 ­-2015 W2 and federal tax returns / tax transcripts.
12. Signed Form I­864 by the I­130 petitioner with the following:
• Copy of job letter from employer;
• Copies of three most recent pay statements;
• Copies of petitioner’s 2015 ­-2017 W2 and federal tax transcripts

 

Form I­765: Application for Employment Authorization

 

1. Form I­765 with 2 photographs attached;
2. Copy of the identification page of the applicant’s current passport;
3. Copy of I­94 upon last entry; and
4. Copy of OPT denial letter to show that I attempted to obtain employment authorization after graduating but was denied due to filing late. 
 

Form I-131: Application for Travel Document

 

1. Form I-131
2. Letter of Explanation for why travel may be necessary.
 
Here are my questions: 
 
- Do I have to send in my W2s and tax transcripts for when I was employed on campus or is this unnecessary since I never gained permission from USCIS to work (since I was a student I was allowed to do so)
 
- Does the copy of my spouses birth certificate (USC) have to be certified?
 
- When does the medical exam expire if done in the US? 
 
- I worked unauthorized for 2 months and paid taxes. Should I include this information in my applications? Should I obtain a tax transcript for that as well?
 
- Do I have to send in 2 certified marriage certificate copies?
 
- I've seen folks saying on here that you need to submit all pages of passport. That's a lot of blank pages to submit, especially as I have two passports. Is this necessary? 
 
- Where do I include evidence of a bonafide marriage? We have a joint bank account, lease, phone plan and I'm on my spouses medical, vision and dental insurance.

Forms G-325 are no longer needed.

Read the instructions for both 130 and 485 very carefully.

All of my evidence is in my I-130 package, as per instructed.

I only included a copy of the marriage certificate in the I-485 and no issues so far.

I don't think you need to copy the blank pages of your passports, just those with visas and stamps.

Definitely list every employer on your employment history, even if you worked without authorization.

You don't need to provide any of your financial information as far as I know (W2, tax transcripts, etc)

10/27/2017 AOS Package sent via USPS - Chicago Lockbox

10/30/2017 Package delivered 

10/31/2017 Priority Date

11/07/2017 Received email and text notifications about all 4 forms

11/14/2017 Received hard copies of all 4 NOAs

11/21/2017 Received biometrics appointment notice scheduled for 11/29

12/15/2017 Interview notice - interview is scheduled for January 19th! Holy #$%^ that's less than 3 months from PD!

01/02/2018 EAD + AP approved

01/16/2018 Combo card delivered

01/19/2018 Interview - recommended for approval

01/22/2018 New card is being produced :dance:

There is no fee for I-765 and I-131 if you're filing them together with I-485

This is my checklist (I filed them in May 2018)

 

Form I-130

7.     Copy of petitioner’s birth certificate & passport;

8.     Copy of beneficiary’s birth certificate & passport;

9.     Certified copy of the Marriage certificate;

10.  Evidence of bona fide marriage.

 

Form I-485 (Application to Adjust Status)

a.   Money order in the total amount of $1,225;

b.   Two (2) passport-style photos of the beneficiary;

c.   Form I-485 signed by the beneficiary;

d.   Copy of the beneficiary’s passport (biographical page);

e.   Copy of the beneficiary’s birth certificate;

f.    Copy of the beneficiary’s Nonimmigrant visa & entry stamp page;

g.   Copy of the beneficiary’s I-94;

h.   Certificate copy of Marriage Certificate

 

Form I-864 (Affidavit of Support)

a.   Form I-864 signed by the petitioner;

b.   Copy of the petitioner’s passport (biographical page);

c.   Copy of the petitioner’s birth certificate as proof of U.S. citizenship;

d.   Copy of petitioner’s tax account transcript (from IRS) for year xxxx - year xxxx and Form W-2;

e.   Pay stubs

 

Form I-765 (Application for Employment Authorization)

a.   Two (2) passport-style photos of the beneficiary;

b.   Form G-1145 (E-Notification of Application/Petition Acceptance);

c.   Form I-765 signed by the beneficiary

d.   Copy of the beneficiary’s passport (biographical page)

 

Form I-131 (Application for Travel Document)

a.   Two (2) passport-style photos of the beneficiary;

b.   Form G-1145 (E-Notification of Application/Petition Acceptance);

c.   Form I-131 signed by the beneficiary;

d.   Copy of the beneficiary’s passport (biographical page);

e.   Copy of the beneficiary’s I-94

 

  • Feb 17 2018 - Arrived USA with B2-Tourist Visa
  • Apr 01 2018 - US Citizen Boyfriend proposed
  • Apr 18 2018 - Got Married in Montana, USA
  • May 15 2018 - Mailed out USCIS applications (I-130, I-130A, I-485, I-864, I-765, I-131) to Chicago Lockbox
  • (Day 1) May 16 2018 - Mail arrived Chicago Lockbox (confirmed by USPS) 
  • (Day 19) Jun 04 2018 - Received email & SMS notification - case received (All money orders being cashed on this day)
  • (Day 24) Jun 09 2018 - Received all receipts (NOA) from USCIS, also the Biometrics Appointment letter (Appointment date: Jun 18) 
  • (Day 33) Jun 18 2018 - Arrived Helena ASC at 9.15am (Appointment at 10am), finished at 9.35am (Yea it was super quick!)
  • (Day 35) Jun 20 2018 - Received SMS & Email notification request for evidence for my I-485
  • (Day 40) Jun 25 2018 - Courtesy letter for I-693 (Report of Medical Examination and Vaccination Record) received
  • (Day 61) Jul 16 2018 - Case status of I-485 changed to "Case is Ready to Be Scheduled for An Interview"
  • (Day 64) Jul 19 2018 -  Case status of I-485 changed to "Interview Was Scheduled"
  • (Day 71) Jul 26 2018 - Interview notice received (Interview scheduled on Aug 23 - 9.50AM)
  • (Day 99) Aug 23 2018 - Interview approved on the spot! Yay! 🎉  I-485 status changed to “New Card Is Being Produced”,
  • (Day 100) Aug 24 2018 - I-131 & I-765 status changed to “Case Closed Benefit Received By Other Means”
  • (Day 107) Aug 31 2018 - I-485 status changed to “Card Was Mailed To Me”
  • (Day 111) Sep 04 2018 - I-485 status changed "Card Was Picked Up By The United States Postal Service"
  • (Day 113) Sep 06 2018 - Conditional Green Card Received!
  • May 23 2020 - Mailed out I-751
  • May 29 2020 - Received email & SMS notification - case received
  • June 1 2020 - Money order being cashed
  • July 15 2020 - status changed to “Case Was Updated To Show Fingerprints Were Taken” 
  • Feb 16 2021 - Status changed to “New Card is being Produce”
  • Feb 19 2021 - Status changed to "Card Was Mailed To Me"
  • Feb 24 2021 - New card received in the mail!
  • Feb 24 2023 - Filed N-400 online
  • Mar 11 2023 - Received Biometrics Appointment letter in mail (Appointment date: Mar 20)
  • Mar 20 2023 - Case status changed to "Case Is Being Actively Reviewed By USCIS"
  • Apr 04 2023 - Received online update "Interview Was Scheduled" (May 23)
  • May 23 2023 - Interview Passed on the spot
  • Oct 26 2023 - Status changed to "Oath Ceremony Notice Was Mailed" (on Nov 9th)
