Green card expired Dec 3rd and I applied for ROC at the later part of my 90 days window, Nov 23rd, a day before thanksgiving. From my tracking, it was received on 25th Nov  but i am yet to get any acknowledgement from USCIS . My job is not asking for my papers cos of evidence of filing for ROC which i presented. Should i be worried for not getting any notification from USCIS cos is almost getting to one month since i filed.

You should have received your NOA1 by now. Have they cashed your check yet? I sent mine  to VSC on Nov 23rd, it was delivered on the 25th.. i received my NOA1 on Dec 10th, with a priority date of Nov 27.   I would give them a call to see if they have a record of receiving it.

Did you send the correct amount? $680. ($595 plus $85)  If not, they maybe returning your package to you, hence the delay.  Have you tried to call?

NOA1 are taking about 2 weeks. Check out the Nov filers thread....most have received their NOA1 and are either waiting for bio apptsor have completed them.

Okay well you have to give them at least 30 days regardless.  

Does it really matter when roc is taking 14-18 months?

Yes it matters, your NOA1 is your one year extention letter.  Op GC expired on Dec 3rd, so technically they are out of status.

No. They just don't have proof of status.

THIS.  You are never out of status unless seen before an immigration judge who makes that determination.  EVEN if you spend 2 or more years outside the USA and try to get back in your green card, you've really abandoned your status but unless you go before an immigration judge who formally revokes your green card, you have status.

Normally NOA 1 will arrive pretty quick. I got my in less than 2 weeks after sending it. I knew few people got theirs too in less than 2 weeks. You should call them again especially your GC is already expired. Good luck.

UPDATE. 

 

Called USCIS today and they acknowledged that my package was received and she wasnt sure why an receipt hasn't being issued to me. She said if no receipt has being issued before 27th Dec, i should call and request for a new receipt. She however gave me a receipt number that started with EAC.......but i cannot check status update with it.

You cant check any status until the biometrics letter.
