I married my husband 10/12/13 in sudan, received approval of I-130 10/2014, my husband interview was july 2015, but his visa was denied Nov 2016 because they said his birth certificate was fake. My husband was born in a refugge camp in sudan but returned to our country Eritrea after the war ended. His nationality is Eritrean. When he went to get birth certificate from Sudan government, they denied him because he is not a sudan citizen. They someone in the office told him they would help him if he paid them. So with no other choice he did. The Us embassy said the birth certificate is not real and asked him to get another one. My husband got his birth certificate from eritrea which stated he was born in Sudan, and got the cetificate authenticate, but Nov 2016 the US embassy denied my husbands visa because they said he committed fraud and needs to get birth certificate from Sudan because he was born in Sudan. My case was sent to USCIS 4/31/17 for review. I file a 1-601 waiver accepted 9/17. And yesterday I received a update i will receive a letter of intent to revoke my I-130. My husband and I are so sad and tired over all of this. My lawyer said they will fight it but does anyone have any similar experiences or ideas of what me and my husband can do. I just want him here with me so we can start our family, as soon as possible. I am at an age were my window for child bearing is get late. And i want to have a baby asap with my husband. But I want us to be together when it happens.

This will be a very long and very expensive battle......Have you thought about relocating to his country or another country?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I agree, this one will be a difficult Hill.

 

To the OP, I am sorry your husband is in such a mess not of his making.  Unfortunately, I don’t have any suggestion other than to potentially contact a senator or congressperson, but I am not sure if they can help in this case.

@missileman thank you for your honesty, I have thought about relocating to Sudan with him but Sudan is dangerous for an Americans and I wouldnt be allow to legally live there since he is a stateless refuggee and also doing have a legal right to live there. Do you know of any other country that both of us could legally immigrate too. We really just want to live together anywhere we can legally immigrate to. I am a US national by birth, leave in Boston, and he is an Eritrean national living in Sudan.

10 year waiverable ban for Misrep, but he needs to get a legit BC, obviously all his other docs can now expect extra scrutiny.

I thought the Birth Certificate was issued where you were born?

@Boiler Im most countries yes, but my husband was born in a little house in a refuggee camp. At that time there was no way for his birth to be record. Then moved back to eritrea as a child when the war in Eritrea ended. After flee Eritrea a couple of years ago he came back to Sudan. The Sudan officials don't believe he was born in Sudan, they ask for citizenship proof, or legal documents of residence which being a refuggee he does not have. But he did get get an estimate of birth from the ministry of health sudan but the consulate wouldnt accept that.

Due to the circumstances in which they are sometimes forced to leave their home country, refugees are perhaps more likely than other aliens to find themselves without identity documents. Moreover, while other aliens can turn to the authorities of their country of origin for help in obtaining documents, refugees do not have this option and are therefore dependent upon the authorities of their country of refuge or upon UNHCR for assistance in this regard.

@adil-rafa thank you for understanding. I was thinking of contacting the UNHCR, in Sudan, but I was informed that they will only register refugee if the go to the outskirt where the refugee camps are, but my husband is staying with friends in the capital city Khartoum. Because the areas were the refugee camps are very dangerous and violent places to be, with sudanese soliders, UN soliders, and terrorists groups have constant fighting, and kidnapping of refugee, then selling them to slave traders, and human trafficker. There are a lot of problems with people disappearing, and ending up with human trafficking. I would not be comfortable with him going there it would be total unsafe.

 

@Boiler @caliliving thank you for your advice, I do have a immigration lawyer, named Sarah Yeomans from Immigration counsel PLLC, http://immcounsel.com/sarah-yeomans/. I have been working with her since feb 2017, after my husband visa was denied. We complete the I601 Waiver, and it was received by USCIS sept 9, 2017, I believe the wait time for that is 6-9 months. But the the Intent to revoke notice was mailed Dec 19, so, we are waiting to see what the notice says, and my lawyer said we are going to fight it, and i have to come up with all evidence to prove that I'm in a bonafide marriage within 30 days of receiving the notice. I believe my lawyer is very good, and capable to handle the case. But if there is anything about the intent to revoke, the process, and how i should respond that anyone knows about I would be happy to hear from anyone. I know my marriage is really, and Im a us born citizen but what I don't know what the embassy officers wrote for reason of revocation, what it will take for them to change there minds and reaffirm my approved I-130, what the percentage of cases of intent to revoke are actually reaffirmed. And how much time this will all take.

@Michael2017 can you tell me more about that. What kind of investment would my husband have to make. I know that standard of living is a lot higher in dubai then the US,  but what kind of Jobs could either he or I find where we could live a comfortable life. I am a nurse assist, and he is a truck driver.
