How is this even legal?

I was not intending to be a downer, but instead was offering a reality-check. Having one's case file transferred may speed up adjudication, or may cause additional wait time. It is also an opportunity for USCIS to lose, misplace, or misfile some of the carefully gather 'Evidence' that was demanded.

My wife and I are continuing to take and print photos with dates and captions, print monthly bank statements and IRS filings, etc. The evidence that we sent in will likely be quite outdated by the time our petition and evidence finally reach an adjudicator's desk, and we will be ready to answer any RFE on the same day that we receive it.

Even with the (supposedly coming) replacement I-797 with the new 18-month extension, most of us will need to go online and get an infopass for our local office, to get an I-551 stamp in our beneficiary's foreign passport, (which cannot be expired), so check your expiration dates and get them renewed in time, if needed. Getting an infopass can take many days or weeks of trying, so know when you should start

(30 - 45 days before your 12-month or 18-month extension to your Green Cards expiration date).

It is a Hurry-Up-And-Wait scenario that we are all trapped in, with no options but to be prepared, and patient. Preparing is easy, but patience is hard.

If your case is transferred, you will receive a notice by mail.

That or you could probably call USCIS and see if they can give you any information about your case transfer that may not be listed on their websites for case updates. I was thinking about doing that but i just dont care enough yet.

CSC still quotes 18 - 21 months, but USCIS is shuffling case files around, to Balance the Backlog, so to speak.

It is unclear if the newly shifted files are 'cut into the order of files' based on their NOA date when they are moved, or just placed at the end of the new line. Either way, it could ad additional months to the wait time, whether your case file is moved or not. "Across All Offices' may give a more real-world wait estimate.

Personally, my wife and I are not following that path.

Some countries, including the United States, allow Dual-Citizenship. However, my wife's native country of South Korea, does not. If we followed the naturalization process, her travels would be limited to the 90-day travel visa to her home country to visit friends or family, just as mine are now when I travel to South Korea.

Additionally, if we should choose at a later date to relocate to South Korea, by her maintaining her South Korean citizenship, it is very easy for her to sponsor me, and I will become the resident alien. As a bonus, if I can achieve a language level (and pass an exam), I can become a citizen of South Korea, and maintain dual citizenship in both the US and Korea. This path that we are pursuing will make travel between America and South Korea much easier for both of us, and we will also be able to start a business in South Korea, should we choose to do that.

With all of these benefits to chose from, it will be in our best interest for my wife to maintain her Korean citizenship, rather than applying for naturalization.

Food for Thought.
