Hey so once I saw your post I actually look at the envelope I was sent and it also came from Potomac and my letter says I've been transferred to CSC. So if I'm right in thinking I went from CSC to Potomac back to CSC. Potomac is a small service center with 1 shift it seems and deals with I130, I90 and the first steps of residency but doesn't show to deal with ROC. I found the below document explaining Potomac, it could also be that applications were sent there for background checks as I didn't have my prints done.

 

With potomac being in VA it wouldn't surprise me that's where they go through your internet history and life with a comb (just kidding, i hope ha).

Very interesting post. I did send mine to CSC initially as well.. guess we are in the same boat 😁. Have not done my print as well.

Big silence aka heard nothing from USCIS after that. 

 

Recently 06/26/2018 received a stupid letter from Potomac center saying they transferred it to CSC(which was where I filed my I751 anyways). Now waiting to see if anything will change. The wait times are crazy. I had almost forgotten about I751 until they sent me the letter. Current administration has a lot other things to deal with i guess :D

It seems like they are transitioning. I can’t even search for my case number on the old site anymore. Just tells me information is not available right now. When I log into the old site account, it shows last update to the case was in april, but no other details or status. 

 

On the the new site, still says last update was they received my biometrics fee on 1/20. 

 

As a a side note, looks like we will all be receiving new 18 month extension letters since they are so far behind with processing cases.

Here is the memo from USCIS which DOESN'T state just visas. It includes AOS:

It's absolutely terrifying. Instead of getting RFEs you just get a denial with no explanation of why you were denied or no request for additional evidence. This article states "visas", but the Memo from USCIS doesn't. Do you think this applies to us going through ROS or Naturalization or AOS for that matter.

My stomach hurts so bad over this. During our K1 we had no RFE, thank goodness. During AOS we did, but it wasn't our fault. The doctor in Colombia who did Luis' medical didn't fill out the vaccine form. So had this policy been in place, we could have been denied without knowing what was wrong.

Personally, I see this change of policy as a positive step by the Administration to clean out the system, which is currently being overrun with incomplete, inaccurate and even fraudulent applications and petitions.

If applicants and petitioners are allowed to just throw data onto their applications and petitions as a 'place-holder' as one immigration lawyer put it, just to get their foot in the door knowing that it will buy them a year of two while their incomplete paperwork clogs up the system, then The System will always be back-logged.

This memorandum issued by the administration allows USCIS to deny FUTURE incomplete applications and petitions. It says clearly on the memorandum that it applies to applications and petitions submitted AFTER the effective date of September 11, 2018. 

SO, for those of us who have done our due diligence, and sent in our petitions, (Which have already been accepted and entered into the system), we have Nothing to Worry About.

This memorandum and change of policy is only designed to allow USCIS adjudicators the discretion and authority to reject New Incoming Applications and Petitions that are Obviously Incomplete. No More Place-Holders.

This new policy will go a long way towards stopping the deluge of 'Place-Holder' applications and petitions that are clogging up the system. THOSE Applications and Petitions are largely responsible for the reason we are all waiting 18 to 24 months for our I-751 petitions to be adjudicated. 2 years ago it was a 6-Month wait.

What the hell is a placeholder application anyway? I seriously doubt there is more than a minute handful of people who apply for random immigration benefits without believing to be entitled to them, given the significant application cost.

 

Now, the ambiguity of some of the USCIS forms & the varying interpretation by USCIS adjudicators about what constitutes significant evidence in cases of K1, AOS, ROC etc leaves the door wide open for RFEs/denials. All this will do is clogg up the juidical process when people sue for being wrongfully denied.

Previously, USCIS was typically required to submit a "request for evidence" on incomplete visa petitions, unless there was no possibility new information could lead to a complete application.
According to the memo, the new policy is "intended to discourage frivolous or substantially incomplete filings used as 'placeholder' filings and encourage applicants, petitioners, and requestors to be diligent in collecting and submitting required evidence."
It adds the new guidance is "not intended to penalize filers for innocent mistakes or misunderstandings of evidentiary requirements."

I would think not.

As I understand it from my research and reading, the lion's share of the applications and petitions that are to be targeted by this newer and stricter policy are Work Visas. Many of the people applying for them, as well as the companies sponsoring them, have become lazy and adopted the attitude and S.O.P of applying with only a limited portion of the required data, and waiting for the RFEs to come back, and only then supplying the information requested by USCIS via RFE's. Essentially, USCIS found themselves spending an inordinate amount of time and manpower completing applications and petitions. This was because of the 2013 Mandate that required USCIS to send RFE's for missing information, and wait a specified length of time before denying an application or petition. People took advantage of that mandate, and the backlog of petitions stuck in the system began to grow. . . and grow . . . and grow.

This new directive allows USCIS to reject an application or petition, (when they receive it) ONLY IF it is Obviously Half-Done or severely incomplete, (hence the identifier as a 'Place-Holder'). Those applicants and petitioners expected USCIS to review their paperwork, identify ALL of the blank spaces and missing data, and then send them REFs, wait for the data to be sent in, and then spend time putting all of those pieces together for the prior-mentioned lazy applicant or petitioner. 

 Further, the memo that outlined this new policy states that it will apply to visa applications and petitions that are submitted After September 11, 2018.

So those of us who filed out I-751s back at the beginning of the year are not included in the new standards.

Personally, knowing how the Government tends to misplace things, or randomly require someone to reprove what has already been proved, (i.e. citizens are expected to keep tax returns for up to 7 years, just in case the IRS decides to demand them in an audit...),

I would recommend taking all of those packets of documentation, from K-1 through AOS to ROC and put them in a sturdy filing box, and store it in a safe location. You Never Know when some Bureaucrat with nothing better to do (or even a New Law Passed) will suddenly require you to produce all of the documentation that you were thinking of offering to the Bonfire.

Just my 2-cents worth . . .

Even now, 7-months into the wait for our I-751 Petition to be Adjudicated and Approved, we are continuing to download and print, and have ready to send our monthly bank statements, taking photos and preparing them with dates, and descriptions, and any other tell-tale documentation. If an RFE should happen to arrive in the mail, our reply will go out the same day.
