Team - it is with great sadness that I write this, but my husband and I are struggling with our marriage/relationship. I have more or less decided to go back to the UK for at least a little while to clear my head, though I may not come back since there is nothing for me here if I'm not with him. 

However, since I am not closing the door on our marriage just yet, I was wondering if anyone knew A) how long I can leave for without interrupting my ROC process, and B) he will remain at our address for the time being, so do I need to let the USCIS know before I know whether this is temporary or more permanent?

K1 Journey - 5 months and 1 day

AOS Journey - 4 months 4 days

ROC Filed - Jan 30 2018

ROC Delivered - Feb 1 2018

NOA date - Feb 7 2018

 

Conditional Green Card expires April 26 2018.

Did you do your biometrics yet? In case they sent you a notice and you miss appointment i guess your case will get rejected.

 

besides that you can stay outside the states for up to 6 months. 

 

If you want to stay longer you would need a reentry permit.

Thanks for the quick response. I haven't had my biometrics yet but I am one of the last January CSC filers so will keep an eye on this forum to see when people start getting theirs if my inclination is to come back.

I was wondering the same thing. Mine was different though.

I actually went back to SSA center after conditional GC, my SSN card ended up with blank and without "Work authorization DHS only" It only has SSN numbers on it. Is that the unrestricted that you guys been talking about?

11 August 2018 - 18 Months extension received (Exp on Sept 2019)

8 April 2019 - I751 Approved

12 April 2019 - NOA and greencard received

hey HGord, I have been updating your information and I feel sorry to hear that. I really truly hope things will work out someway or end up the best for both of you. If you need anyone to talk to, you can always message us here or talk to us bout it. We will definitely be a listening ear. 

I remembered when I asked USCIS before my vacation, if I can just go abroad without waiting for biometrics, she did mentioned that failing to appear on biometrics means abandoning of the GC application. I am not sure how many people who missed their biometrics successfully request for it with valid reasons and work. 

But she did told me either I risk it or forget the whole trip. I believe also because mine was just a "vacation" so it wasn't a valid reason if I missed it.

Luckily for me, my biometrics came few days before my planned trip.

Technically speaking, you're not separating. It's pretty normal that you have ups and downs in your marriage. As long as your husband stays in your current address, I think you're totally fine.

Until you decide to separate, which I hope it won't happen, I dont think you need to do anything.

Don’t  Be afraid, those things also happen. I couldn’t with my marriage and got divorced.. Personally I think it’s not worth it to live a nightmare for a stay in here, i got into my marriage in a good faith, just that it didn’t work so I had to file the ROC by myself. My lawyer says everything is going to be ok ‘cause I had a real marriage, just that it did’t work.. I know this process is a little bit stressing but it would’ve been even worse if I had not gotten divorced

so I am getting another letter from USCIS today not sure what it is about yet  I guess i will find out once I get home, I am quite confused though as it has only been 10 days after my biometrics, Why do they send me a letter.....

Really weird - I went to SSA office with conditional GC for replacement and they sent me SSN without any restriction. I don't see "Only for work authorization DHS" written on my current SSN card which I had it on old SSN prior to  conditional GC. 

 

I really hope, my HR don't ask for documents again - I joined current job  on Employment Authorization and Advance Parole Card then I voluntarily submitted my conditional GC once I received in hand. 

N-400 Application Timeline :

Application sent via mail - April 15th  (Field office Dallas, TX)

NOA Receipt date - April 17th

Biometrics receipt - April 22th (appointment scheduled for May 14th)

Biometrics completed - May 7th (Early Walk-in)

Biometrics completed - May 7th (Early Walk-in)

Interview scheduled notification - November 12th (via email - waiting to receive letter in mail for actual Interview date)

Interview completed & Case approved - November 17th

 

Naturalization Ceremony (in January 2020 - waiting on notice)

That is a restricted one because he applied it with EAD

 

If he goes in again with both Extension + expired GC, he should be able to get an unrestricted one. 

Unrestricted SSN card + Drivers license would be enough for dealing with i-9 if hes a new hire.
