He did show it, it did not expire yet, will expire on 1/30/19. However, this is a new job that he just started on 1/7/19.

Ok, so he showed them his expired green card plus one year extension letter when he started the job last week. That’s a different situation than an unexpired green card. Does he have an unrestricted social security card (a normal one, not one that says “valid for work only with dhs approval”)? If so, he can use that and a drivers license to prove his work eligibility. If not, get him an infopass appointment and get a stamp in his passport. For infopass appointments, I’ve always heard you need to check often and at different times of day/night for appointments to become available.

Yes, he has an unrestricted social security card. I will have him contact HR about that. I was able to get through USCIS on the phone, our local field office will contact us in 48-72hrs to schedule an appointment. Thanks for your help!

We filed the I-751 in January 2018, but the N-400 in 12/2018 and had the biometrics appointment on 1/4. I used the guides on VJ, VJ searches and some online research, but the process was pretty easy. Uploading and deleting files is simple and intuitive. You can upload as many supplementary evidence files as you want (not necessary, but I prefer to front load evidence) as long as they're each below the file limit. The online notifications in our USCIS account show up before we receive the paper copies, and you have the option to download copies of the letters from the updates.

We just hope the process doesn't drag on too long....

Most of the January 2018 I-751 filers have received both a 12-month extension letter and a (second) 18-month extension letter.

Yes An Appointment At Your Local Office is Necessary AND WORTH IT.

SO, when your 12-month extension letter has only 30 days or less remaining, you should go inline here:

https://my.uscis.gov/en/appointment/us

and make an INFOPASS appointment. They only schedule out to two weeks forward, so it may take several tries. Once you make the appointment, your spouse should take his UNEXPIRED foreign passport, and all appropriate paperwork, including the expired greencard and soon-to-expire 12-month extension letter, and your local office will place an I-551 stamp in in his passport. This is the same as an extension letter. I-551stamps are sometimes for 6-months, sometimes 12-months, depending on the Local Office.

Thank you! I was able to make an appointment today, still waiting here!

This is the fastest infoPass appointment i have seen. Good luck. No employer can terminate you for the expired green card. Have your hubby show the I551 stamp to HR and it should be okay.

Awesome! With the i-551 stamp he will have 2 options to show his employer. They can’t terminate him. The i-551 counts as a List A document for the i-9 and they are not supposed to re-verify that when it expires. He could also use his drivers license and unrestricted social security card as List B and C documents for the i-9. That won’t have to be re-verified either. (My husband also just started a new job 2 weeks ago during his roc process so I just did a bunch of research on this).
