The court wouldn’t examine his green card petition USCIS would, also with the majority of VAWA petitions he could apply for an EAD and AP to work and travel legally which would also allow him to get his own SSN.

Using a fake SSN rather than a stolen SSN is the lesser of two evils. Though, doesn't make the situation any better.

 

Curious as to why the wife never filed for CR1, or even AOS, after all these years. And how his attorney plans on moving forward with obtaining permanent resident status without the help of the wife.

If you are his wife trying to dob him in for working illegally - all I can say is if you remained married over 10 years and somehow avoided processing his paperwork there's an issue more with you than the man.  either the wife should have left him or helped with processing papers.  Not simply had 3 kids and leave him in limbo with threats.  his life is obviously messed up as he can't live in Italy or the US easily now.  If you are the wife - note he likely does have his papers sorted and is not informing you.  Its unlikely ESTA has been allowing him to visit over so many years without questioning it.

You can call ICE or USCIS many times and usually they don't go after 1 illegal only, they don't care, specially about people who is working. He probably is working, paying his child support, paying his lawyer for to stay in US and continue to pay for his children. It looks to me he is trying to be around his children, any other man who doesn't care, would be gone and never see his children again

I can't help but feel like you are seeking this information under false pretenses. Whether you are the wife, or someone else looking for a reason to deport or simply report this person. I surely hope not. And it may be my instincts from previous jobs in fraud kicking in. And also your handle stands out to me as "Identity Theft Department" every time I see the acronym. :P (bad joke)

 

If that is the case - that's truly unfortunate. Regardless of personal relationships and opinions, anyone going through any type of immigration process has enough to worry about, cover, and deal with than also deal with someone trying to throw a wrench into the plan. Speaking as someone whose beneficiary fiancé has an ex spouse who has attempted very such things (poorly and unsuccessfully, but still). I hope if this is the situation, you choose to carry on and allow someone to live their life and make their own (alleged) mistakes or missteps in the immigration process.

 

If that isn't the case - I'd still let this person work it out themselves. Immigration is tricky. There are a lot of moving parts, most of which a random third party advocate would likely not be privy to. You could potentially cross wires or get/give incorrect information. Just my opinion. There may be more to the story you aren't even aware of.

I just don't understand your obsession with someone else's business that is causing no harm, that you have mentioned, to you. 

Identity theft is a problem for all.   Just wait until someone steals your credit card and charges thousands.  Just wait until you get an IRS bill for the taxes on money you did not earn.

Without any question of doubt, said person is actually the person who started this thread and is actively posting.  I thought that was a given and we were just looking past it?

All crime is a problem for all. Identity theft is certainly less harmful than some things that could happen to you. DUI caused my family far more pain than identity theft ever could - my husband lost his brother to a drunk driver. 

 

I don't understand the OP's obsession with this individual's situation and his posting it on a public forum. If he wants to crack down on people's wrong-doing there are plenty of campaigns he can involve himself in that help many more people.

Illegal aliens often use "fake" SSNs. But it is one thing if one uses her cousin's SSN, with the cousin's agreement, and a completely different thing if one uses a SSN without the owner's knowledge. Both acts are illegal but the latter is a much more serious crime a.k.a. identity theft. Victims of this crime can often have their lives ruined, especially if they are immigrants.

More generally, the more immigrants who are here illegally, who work illegally, who use fake or stolen SSNs or green cards etc,  the worse the reputation that immigrants in general get, and the harder it is for ALL people who want to either visit or immigrate to the US.

Indeed. Just look at the RAISE Act - it's a merciless attack on legal immigrants (especially on scientists and other highly skilled legal immigrants) and it has a good chance of passing because of the illegal aliens. That said, I do support some form of amnesia for those who did not break other laws and who passionately want to legalize their status and don't just blame the society as a whole for their situation... and are willing to go back in line behind the legal applicants.

It is still illegal and the cousin is complicit in the crime and is no better than than the person illegally using the SSN. Does Cousin not understand the implications of someone using their information and the long term problems.  People knowingly creating problems for themselves give me a headache.
