Speaking from someone whose Identity was stolen last year. Stealing someone's SSN is a felony in the US.

01/31/17.... K1 Visa Approved

02/03/17.... K1 Visa Received in Hand

06/05/17....Arrived in the USA (LAX)

06/24/17....Married on Cape Cod <3

 

07/10/17....Sent AOS package (I-485, I-131, I-765)

07/17/17.... AOS notice date for NOA1 (I-485, I-131, I-765)

07/21/17.... Received mailed hardcopies of NOA1s

07/29/17.... Biometrics Notice received in mail 

08/01/17.... Biometrics Appointment AOS - complete (walked in)

08/07/17.... Biometrics Appointment EAD - complete (walked in)

10/23/17.... EAD/AP card delivered to house YAY!

I know of one person (personally know them) who not only crossed the border illegally, but also worked under a "fake" SSN...but it became more complex to unravel since her and her mother (a US citizen) shared the same first and last name, so the person used their mother's SSN number when applying for the job/opening a bank account/etc.

 

She ended up appearing before an immigration judge and pleaded her case.

 

I am not privy to every detail surrounding her case, however In the end she was able to adjust status legally (she also had 2 US-born children and a divorce from a USC spouse) and has the 10-year greencard now.

 

Yes, it could possibly compromise everything, but it also depends on many variable factors I suppose, given that she succeeded.

 

Note:  I am not advocating her situation in any way---just stating what happened in the end from my knowledge.

Give that the person has committed crimes, he needs to engage an attorney - or two - rather than rely on a forum.

May be it's not STOLEN but simply FAKE. One hast to work to survive while waiting for the Court to examine his Green Card  self-petition.

I am not the person in question, honestly. I am a third party. During their marriage AOS was never filed.

He's definitely on shaky ground immigration-wise.  Using a fake SSN opens up another can of worms, too, not only for him but also his employer since he was aware/provided the fake SSN number.   That's not to say his situation is impossible to overcome with a very good immigration lawyer.

 

He may want to consult a criminal attorney as well----whether the SSN was "fake" or "stolen" doesn't discount the fact that it is still fraud either way.

This is rally the issue here.  There are two completely different things this guy is doing that can cause him real problems in the future.  He needs to consult with several attorneys for both the immigration issue and the fraudulent work issue.

Maybe they should have looked into a Tax Identification Number instead. https://www.irs.gov/individuals/individual-taxpayer-identification-number

 

Unfortunately they have now complicated the situation by faking/stealing a SSN. I am not very sympathetic to identity fraud as I have personally had someone steal my SSN. It took about 6 months to reclaim my identity, missed hours of work, multiple visits to the police station, and over 60 hours of phone calls. Not to mention I had no access to any of my financials for over 30 days because of the mess that was created.

OP mentioned this is in California, a Sanctuary State.

 

Millions use fake SSN's. Can not see one being that high up ICE's priority list, now if there are a few hundred working for this employer maybe.

Unbelievable ! California has adopted the most expansive “sanctuary state” law in the US with the goal of obstructing Donald Trump’s deportation agenda by prohibiting police in the country’s most populous state from cooperating with federal immigration authorities.

Here is an article that provides some insight of what a Sanctuary City means for the state of California.

Spouses don't "grant" green cards. It appears you know very little about how family-based immigration works. That's not a criticism - unless they are personally involved in the process the average American has no idea how it works because they don't need to know how it works. And he cannot obtain one on the basis alone that his wife "didn't grant him one". 

 

Given that you know so little of the process, it's quite possible that he is here legally and you don't know about it. I don't discuss my immigration status with total strangers, so why would he? Maybe it's best to keep yourself out of matters that don't concern you. If you are asking these questions because you feel he is committing a crime of some sort and you want to see him punished, that's all well and good but there are people in this country committing far more heinous acts than working illegally to support their three children. Why not focus on them?

Forgive the expression grant. I know the USC spouse fills in the form etc to obtain the green card for the non US spouse.Whatever Law number that can be or Visa number.... That never occured. And I can guarantee he is now in US with an ESTA Visa, , entered in US 18 October, meaning 3 months stay.

Working illegal is typically forgiven for those immigrating with CR-1/IR-1 visas. However, as others have stated, the use of a false/stolen SSN is a criminal offense. I can't say for certain, but I imagine that a false SSN might be looked at differently than a stolen SSN (no direct victim vs. direct victim), but that may not matter in the case of an ongoing petition for immigration. Either way, this individual should contact an immigration lawyer and get some advice, as their immigration may be in jeopardy.

And why is this any concern to you? Is he using your SSN? Is he doing the job that you applied for but were not selected for? Are you the wife or one of the three children? 

 

I just don't understand your obsession with someone else's business that is causing no harm, that you have mentioned, to you.
