An italian citizen with a tourist visa (3 months) nearly expired,  is currently employed using a fake /or stolen SSN provided directly by his boss also italian (friend) .

He uses even a clockcard for his wage and gets paid by check ?? Possible ?

What happens if ICE office finds out ? How can they find out ????

They wouldn't find out unless someone reported the fraud to them.

ICE is based in Washington, and they cover the entire USA.

The consequences that would follow would depend on whether they (ICE) found substantial proof of the wrongdoing during their investigation.  They can't deport someone on the basis of a report only, of course.  Immigration hearing before a judge would happen first, and the person would be able to present their case.  If the person has proof of no wrong-doing or can compel a judge to allow them to remain in the USA (ie. hardship on any USC children/USC spouse as one example), there are then other avenues that may be open to them immigration-wise.

 

As to whether action would be taken in a "short time", most unlikely, considering manpower and priorities.   

Has this person actually admitted to you that they are using a fake/stolen SSN?  Are you certain they are in the US on a tourist visa only?

Yes.This person admitted he is using a fake SSN, and the tourist VISA expires on 18th january. This man was actually married to a US woman but now divorcing. Reason why she never granted him a spouse green card ! although children were born under their marriage with US citizenship. Court case is still undergoing for divorce. But anyhow he has no green card at all. He's been always be moving back and forth between Italy and US under Tourist visa.

If they ever filed paperwork for him to adjust status, it's quite possible that he is still going through that process using a divorce waiver.  If he is undergoing the AOS he is able to remain in the US legally while the application is pending (even if his tourist visa expires).

 

The fake SSN is unfortunate.

I see. Let's say he will be legally entitled to remain in US while AOS is pending. What about his current employment under a fake SSN ?

If it's proven that he committed a crime (using a fake SSN) then he could face a fine/jail time depending on circumstances.  

The employer could also be in trouble at that point too,  if proven that he provided the fake document.

 

Another thing to note----earlier you said the wife has "never granted him a green card", and that was the main reason behind the divorce...the way you worded it sounds like she was holding his immigration status (or lack thereof) over his head at times...  He may be continuing his AOS under a VAWA waiver as well (physical/mental/emotional/financial abuse) if he has proof of that and proof of entering the marriage with bonafide intent.   

 

Of course it's all speculation at this point without hearing directly from him/the wife as to the facts.

Indeed he is self-petitioning for a Green Card now assisted by an attorney, but so far no guarantee and no idea of time. Thank you anyway.

I'm assuming they married in the US while he was on a tourist visa and applied for the AOS from within?

 

Curious about the EAD too...

You are correct. She never filed a CR1 for him and now file a motion for divorce moving to AZ with children and new boy friend., marriage deteriotared through the years. Have 3 childrens 4/7/10. Now he is working with no auth using a fake SSN. Meantime is applying for Green Card based on fact that his wife never granted him one, and if he wants to work and live in US and see his children and pay alimony, must get a GREEN CARD

ICE finds out and deports and person has a ban

but IRS finds out and there is a federal trial and federal prison time and then a permanant ban for the federal crime

plus same federal crime by the boss

 

this is about as poor an idea as i have ever heard

Yes they married in US under his Tourist Visa, at least 10 yrs ago. Lived back and forth Italy and US with family. But he never ever got a perm residency and or Green Card. His Immigration attorney is working on that. Buu now that he is working let's say illegally..and with a fake SSN could possibly compromise evrything ?

OP,  you are more worried about someone committing identity theft than the person whose life he is messing up.  Do you realize how many problems the use of a stolen SSN creates. Untangling all of the other issues, IMO, are secondary to the fact he is committing at least one crime.

 

Give that the person has committed crimes, he needs to engage an attorney - or two - rather than rely on a forum.
