F1 Visa Green Card acquisition

Hi there,
I have a question about F1 Visas. I have read somewhere that F1 Visa holders may be able to acquire a green card within certain conditions.
I found them from this article : http://www.katzlawchicago.com/blogs/687-how-f1-students-can-apply-for-a-green-card

I wanna know if this is true.

If these are true, I also have questions for the following:

  • Military Service - I have read that joining the military as F1 Visa holder (staying at least 2 years) may grant you a green card.
    • I am unsure how it works, can someone elaborate me with this? Does it give the same benefit as other immigrant joining the military?
  • Parent Child Sponsorship - I have read that parents or child who are at least 18 years old, then an American Citizen child / parent may sponsor you for a green card.
    • Does this apply to step-parents who are divorced from my biological father?

This is all what interests me at the moment, I will appreciate your answers.

Thank you!

I actually met a couple of guys who went the Military route, they said the programme had now closed.

Depends how old you were when your father married the USC and if she is willing to sponsor you.

I actually read more about this MAVNI program for the military route, and just now it says it's not accepting more applicants at the moment. Although it may re-open very soon.

I was below below 18 when my father married the USC. So I guess that applies

They are Chinese and Mandarin was on the list.

Then she can sponsor you.

One of those is not an option, well currently and the other is unlikely to occur during the course of any Degree so yes you would be going home.

Hi again,

Excuse me for my recent multiple posts of questions. Although I am finally figuring out my decision and solving this puzzle.
I hope to finalize this with few more questions ahead, so if you would be able to help me, I will appreciate it.

So during the course of F1 Student Visa, it seems that the parent / child sponsorship is legitimate?
Does this mean that the following actions is accepted?

  1. I apply as an International Student F1 Visa
  2. My mother will be petitioned by my U.S. Citizen brother (IR-5)
  3. I may be eligible for Green Card sponsorship?
  4. My mother will sponsor me a Green Card as LPR or USC? (Which one does it have to be?)

I want to know if this is really legitimate. If it is, in what period am I eligible for sponsorship?
After I get my degree?
During my 1 year Post - Optional Practical Training (OPT)?

Yes

Yes

Both your Brother when he is a Citizen and you mother when she is a LPR can [petition you.

Either, as long as you are single, USC if you marry.

You are eligible to be petitioned once your brother becomes a USC and/or when your mother enters the US on the IR-5 visa.

This can occur concurrently with an F-1/OPT. You cannot remain in the US after your F-1/OPT status expires.

From PH the process will take ~20+ years as a sibling, or ~7-10 years (closer to 10 now) as the adult son/daughter of an LPR. So it's optimal if your mother applies once she is eligible to do so. If she becomes a USC and you remain single, the timeframe is closer to 7 years. If you marry before she becomes a USC, the petition is abandoned. If you marry after she becomes a USC, the wait approximately doubles.
