The DS260 is only a form you fill out with all your information so that the embassy can look at it before you arrive at the embassy, and a lot of times they have already made a decision before you get there. The fact that you can change it from married to widow doesn't mean anything. You will get denied because the person you applied, your husband, sadly passed away. I am sorry for your loss but there is nothing you can do. Why are you so intent on going to the US now that your husband has passed?

You received it because you submitted a DS260 under a selected case number. It’s as simple as that. KCC just do admin, they can’t disqualify a case. If they receive a completed DS260 and the case number is current they schedule an interview, whether or not they believe the application is qualified to receive a visa. Only a consular officer can approve or deny a case. KCC have probably flagged your file for the embassy as it is probably clear to them that you do not qualify, but KCC cannot deny a case because it does not employ any consular officers, who by definition can only work at a consulate or embassy. If you don’t believe what anyone here has to say, there is certainly nothing stopping you paying your interview fee and attending the interview if you want to hear it from a consular officer instead.

I'm sorry for your loss, but I don't think you have thought this through.  First, immigration is very expensive -- for the visa process, the travel, establishing a new residence, etc .   And, settling into a new country, with no support, limited English (based on your posts), with no little to no legal access to government welfare/support systems, will certainly be more difficult than staying in your home country.  Please don't spend anything from your limited resources to try for the visas.  There is no way they can be issued, as others have said.

 

I hope you find the best way forward for your family.

I agree. America is not easier. It's not like in the tv shows and movies.

I know it is not that relevant in this case but whilst you do not need to have a sponsor I believe you do need to show you will not be a public charge.

I came to USA on DV 2006 visa and if i recalled correctly, i had to pay a certain non-refundable fees before interview . I would not got those fees back if i had failed the interview.It actually happened to a family (consist of 5 members and had to pay fees for each person) i knew .So, I am agreeing with all others.It will not be a good idea to spend all that money when you are clearly struggling  and 100% possibility of deny.

Indeed. There is a visa fee to pay, just as there is for any other immigrant visa. "Winning" the GC lottery isn't an automatic ticket here, wgat you have essentially won is the equivalent of an approved petition. There is still the visa application and medical process to go through. There's no 100% guarantee anyone will be granted a visa. 

 

But the visa fee is a drop in the bucket compared to what happens when they arrive. Let's assume OP was still able to get the visa. After she landed at the airport here with her 2 children and a few bags she would be on her own. The visa doesn't come with a job, house and car. All of those have to be worked for. She would have no credit history here so finding somewhere to live would be difficult. As would buying a car and furniture. She says she's struggling now but being homeless and jobless in the USA with no family support network to speak of is even more of a struggle. And that's before we start talking about healthcare. The streets aren't paved with gold.

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Like everyone else is saying your DV is as good as over. My condolences to you and your family, but you weren’t the one applying for DV. Your husband was the one. You were only going along because you were legally attached to him by marriage. Had you not been married, you wouldn’t have even been considered. It’s like you’re the third party in this whole ordeal. If you lose your common string attaching you to this visa program, ie your husband, the whole process is shut down for you. 

The reason why you’re still getting paperwork on this is because their systems haven’t caught up with your husband’s passing. A lot of paperwork needs to be done when one passes and it takes months sometimes years for it to reach everyone and change statuses on systems. It takes time. 

When you get to that interview, they’re gonna ask for your husband, most likely he is the only one allowed in the interview, when you get there and tell them you don’t have your husband, they’re just gonna say bye and won’t even see you. Don’t waste whatever money you have left on a dead petition. 

 

If if you still think you wanna immigrate to the US, you need to find another way.
