Swalwell mocks report that Mueller obtained Trump transition emails illegally

California Rep. Eric Swalwell (D) ripped the Trump administration on Saturday for claiming that Robert Mueller's special counsel office had obtained tens of thousands of emails from the Trump transition team illegally.

Swalwell responded Saturday to the claim from 

A lawyer for Trump's transition team, Kory Langhofer, claimed earlier in the day that Mueller's team improperly obtained thousands of emails from the GSA, which managed the transition team's email accounts.

I am not sure if obtaining the emails was wrong, but if Mueller’s team is using privileged and confidential information between lawyer and client then it does raise an ethical question.

It appears that the emails were taken from gsa servers and that no warrant was needed. Because the transition team acknowledged that the emails were government property as part of their usage agreement  and that the emails were from before swearing in on Jan 20, there is no executive priviledge. Not sure about ACP.

I agree with that, but that doesn’t negate attorney client privilege.  If any of those emails are so deemed, then Mueller cannot use them ethically speaking.  It doesn’t mean his team cannot have them, but if a lawyer can prove that they were used materially then it could pose problems.

Mueller can gain access to them. He (most likely it would be a team of individuals that has the goal of sorting through them and discarding - not himself) has the right to review them - whether he may use them or not is another matter. No evidence that they will be or won't be used. And that is completely normal actually. There have been cases of prosecutors attempting to use them, and the defense will usually duke it out before a judge to decide. They are typically agreed upon to be discarded with no further issues whatsoever. This is a big load of lawyer bluster.... and it's not even a good argument either. They have no expectations of privacy here. If they were so very concerned about it being viewed, the lawyer could have obtained an order restricting access - but they simply did not. That's their stupidity.

A year ago I heard it was 9 months ago. I must have missed it. Apparently now it is moved to one year from todays date…..no matter which day it is.
