Hi ,

I had a question regarding traveling after receiving an Immigrant Visa through the F4 category India.

 

Supposing, I receive my Visa after my interview and I travel to the USA, will it be a problem if I travel back to India within a week of immigrating?

 

I.E.: I am the principal applicant for F4 India category. I plan to travel to USA with my spouse and 2 kids. My spouse and kids need to come to India to complete their academic year in school? So, I need them to travel back to India after 8 days. They will return to USA once the school term ends.  Will there be any hurdles when the travel back to the USA after completing their school term in India?

 

My interview is in Jan 2018. If all goes well, I am planning to migrate in Jan, but my wife and kids need to come back to india in 1 week because of term end examinations in school. They plan to return to the USA in April 2018. 

Please let me know if this is a good idea? Will there be an difficulties?

Would I have to apply for Advance Parole or Re-Entry for them? I'm just curious whether or not they will question my spouse and kids as to why the immigrated and left the country, e.g: why are they doing back and forth even after receiving their greencard?

No, neither one is needed. The endorsed visa will suffice.

 

Technically, they can determine that residency was abandoned at any point, but ~3 months abroad to finish school likely won't raise any concern. I do suggest using whatever time you do have in the US to establish ties there just as a backup.

I don't  know  for sure but you  may not be able  to enter  back into USA if you don't  have your greencard. It take  at least  a month to receive  greencard  in mail. If i were you i would  ask  the immigration  officer  at the time of the interview. As i understand  if you don't  have your greencard  you will not be allowed  back entry. I think  the visa stamp in your passport is only  valid  for 1 time entry.  I am sure you will  have to get special  permission but 8 days won't  be enough  time to go thru  the process  to get permission. It takes all least  a month  to receive  your greencard  in mail after  entering  USA that's  only if everything  goes smoothly. I mean  things  happen. We had a family  who came on F4 visa had to get their  finger prints again. They didn't  get their  green card for 45 days and when  the called they found  out they missed  to pay $120 fee that should  be paid  after  getting  their  visa(at the time of your interview should  get an instructor to pay this fee) . So they paid that than  got a letter  they have get their  finger prints  a again. 

PS. You can  pay $120 fee in India  or after  entering  USA. I heard  if you pay  in India it process  goes much  faster  means you get  your within two weeks  vs. 6 weeks.  

Btw what  grades are your kids in? They may be able  to continue  with the same  grade in USA. They will have to take  a placement  test  to see what grade  they  will be in .

The visa is only valid for one entry, but the endorsed visa is a temporary green card for 1 year. It says so right on it. It's no less useful than the physical green green they mail to you.

Agree but i know someone  who went back to India without  their  greencard  was not allowed  back to enter USA.  I am sure there is they would  have to get special  permission  to do that. Not sure.  But if it was me i would not take a risk. Kids education can be continue  in usa with them having  to finish  their  year in India.  BTW i think the visa endorsement  is different  for every  category. I came to USA on F1  the endorsement  in my passport  was good for 10 years. But now our family  F4 says F4 temporary visa.

I can't comment on another case without details, but I will just reiterate that the endorsed immigrant visa is treated the exact same as the standalone green card by CBP (and is to be treated the same as it everywhere else too). If somebody was denied entry, it would have been for a reason that would have done so with the standalone physical card (i.e. abandonment of permanent residency?). The other exception is not being permitted to board because the airline staff don't understand what the endorsed visa is, although this is quite rare (and would be worked out with the airline...not CBP).

 

The visa itself will say "UPON ENDORSEMENT SERVES AS TEMPORARY I-551 EVIDENCING PERMANENT RESIDENCE FOR 1 YEAR". The I-551 is the green card.
