lHello all.  Two weeks ago my husband and I got married on a K1 fiancee visa.  He is from Canada.  We are looking over the forms needed for AOS and work VISA.  We are so confused with everything regrading the AOS.  It says on the USCIS website: "Most people who apply for a Green Card will need to complete at least two forms—an immigrant petition and a Green Card application."  Then it has a form I-130 petition for Alien relative. 

 

  1. Am I supposed to fill out this form for him (I-130)?  I feel like I already did this when I petitioned for him for the K1 VISA
  2. Next, "Check VISA availability (If Applicable)" I looked at the links they provided for this but it still seemed like Chinese for me.  Will we have to wait until a specific time or date to file for this Category?
  3. I went on the step by step AOS thread here but it was from 2005.  Are all those forms current now?  According to the USCIS it looks like we will only need to file form I-485 and possibly I-130?  And send in Money?

Hi, no you don't need to fill in i-130.

You already filed i129f.

You will need to fill in your i485 aos i864 affidavit and i131 if you want a travel doc  also i765 authorization for work permit all together at once and attach a cheque for 1225.00

Yes that helps tremendously!  Quick question, would he have an Alien registration number or I-94 number yet?  We are trying to fill out the form for work and it asked that but we were not sure if we had one?  Also, what do you mean for "if you want a travel doc?"  Thanks again!

Yes he would have an i94 if he didn't receive it when he came through customs than he can go to https://i94.cbp.dhs.gov/I94/#/home#section and type in his passport info name etc and you can pull it up and print a few copies you'll need it for aos ead and ssn

 

You may want to apply for a social security # at your local social security office As well as it takes time to get and needs to be done prior to your i94 expiry (within 3 months I believe)

 

 I131 is a travel document to get in and out of USA because you can't travel outside of USA while on a pending aos otherwise you won't be able to get back in. (Optional) its free if you apply with everything else all at once.
