B2 visa and stamp in passport

Hello all,

 

My mom comes to the US once a year for 5 months to stay with me (she is retired) and always get a stamp in her passport for 6 months stay allowance (Poland is not a part of the VWP). Last time the Homeland Security Officer put a year instead of 6 months. She is scheduled to return to her home country before the 5th month expires and we are planning on starting the petition to bring my mom to the US to stay with us for good.  Can the officer extend her stay just like that?

A year? That doesn't sound right...6 months is the max granted at entry on a tourist visa. Did you check her I-94 online just to confirm?

Theoretically they can give a year, maybe the last person was so entitled and the date was not changed?

Thanks for the update. Then yes, she's good for 1 year. I actually had to look it up but 1 year at entry is technically allowed by law (just so very, very rare).
