what is the process to bring step children to the U.S

Recommended Posts

My husband came to the states this year in Feb., now we would like to bring his children here.  What are the exact steps and what paperwork is required. I tried calling to get a better understanding but of course it's like calling a radio station to win a prize.  Please any input would be appreciated.

How old are they, is their Mother OK with this?

The process time is different if the children are under age compared to those that are adults.

 

Also, as @Boiler mentioned, you may need the mother's consent to bring him here.

did he proclaim he had children when you made the application?

they needed to be listed even if not coming at that time

is he listed on their birth records?

if not,  he will have to do DNA to prove they are his

as said needs permission from mother or their guardian (in case mother is not in their life)

Are they children or adults?

questions immigration  will have are:

why did he come on K1 (unable to work for several months )  therefore unable to send support for these children?

i am not judging you but to immigraiton looks like he abandoned them / we have seen immigration react to this before

Who will go on their  interview if they are underage as he can not go back without a green card / so does he have one?

Why didnt you apply for them at the time of his K1 visa?

all the above is to let you know what you are in for as you will face extra scrunity for their applciations

We went through this process this past year and none of the questions you mentioned (Kris and me) were asked to us. I'm sorry if you had to go through this

My husband the step father and U.S. citizen petitioned for my GC two years ago. My child decided to stay with his grand parents for another year, so we initiated his process last year. We had his interview a couple of weeks ago and they only asked questions about our relationship, when my husband and I got married, if the child had been in the U.S. There was no mention of his biological father, or permission, or me abandoning him o sending child support. I was asked the same questions I was asked during my (mom's) interview. 

 

Myfuture, you would need to initiate the process for your stepchildren just like you did for your husband. If your husband and you are already married and the children are under 21,  they would fall under IR-2 category. I would suggest you begin the process sooner than later, as wait times for approvals and interview dates are becoming longer and longer.

Hi. It took over a year. We sent the I-130 and documentation at the end of September.

 

NOA1: 10/03/16 

Case transferred from Nebraska to Texas Service Center: 02/22/17

NOA2: 04/24/17

NVC Scan Date: 6/26/17

NVC Case Complete: 8/28/17

Medical exam (CDJ): 11/24/17

Fingerprint appointment (CDJ): 11/27/17

Interview date (CDJ): 11/29/17

Passport & Visa received: 12/07/17

Hola a todos!!

Soy nueva en este foro, los he leído un poco en busca de información, mi caso es algo parecido al que mencionan aquí y por eso me atreví a exponer mi caso y mis dudas, espero no cause molestias, soy ciudadana pidiendo hijo menor de edad, mi hijo esta fuera de usa, no lo pedimos cuando pedí a mi esposo porque no sabíamos que se podía hacer eso y cuando lo supimos no teníamos el dinero suficiente, así que decidimos que el fuera el primero para que pudiera trabajar y poder pagar lo demás, tengo más hijos y con ellos pude hacer el registro consular(por cierto muy fácil y barato) aclaro: primero fue la residencia de mi esposo, luego registro consular y ahora proceso de residencia para mi hijo.

El día de ayer nos enteramos que ya fue aprobado, estaba en el centro de Nebraska, ahora la información que necesito es respecto al formulario I864w, creo que aplica en mi caso porque ya he leído varias veces las instrucciones, pero en otro foro me han dicho que mande el formulario i864, i864a y el i864w, ahora mis preguntas:

1¿Debo hacerlo así? 

 Si la respuesta es sí:

¿Hay algún problema si mi esposo no completa la cantidad requerida?

Si la respuesta es no:

¿Qué documentación debo mandar con el formulario i864w?

Tengo más dudas, pero por el momento estas son las que más me preocupan,espero que me ayuden y muchísimas gracias de antemano a qui pueda ayudarme!!
