i-751 evidence - joint communal residence

Timeline

For our package we have the following:

  1. Permanent Resident Card

  2. Social Security Card

  3. Marriage Certificate

  4. Driver's Licences

  5. Credit Cards and Bank Card

  6. Joint Savings Account – Bank Checking Account Statements

  7. Credit Card Bills (a. Visa, b. MasterCard )

  8. a. 2015 Income Tax Returns, b. 2016 Income Tax Returns

  9. a. Health Insurance Confirmation of Elections Details (2017 & 2018), b. Health Insurance Cards, c. Health Insurance Documents (Rebate Rewards Letters and Dental Bill)

  10. Joint Utility Bill, a. Electric Bill 

  11. Phone Bill ( Family Plan)

  12. Self-Employment Estimated Quarterly Payments

  13. Trips and Vacations

  14. Invitations

  1. Affidavits

  2. Photos

 

However we don't have joint communal residence.  The home is owned by my husband (USC), and paying the mortgage (under his name).  I have read about the options on the forum about adding my name to the deed, etc.  I have decided to not add my name mostly to avoid the costs.  So, I'm not sure if we should send the package without info about our residence or should we send them something explaining my husband owns the home we're living in and paying mortgage?

 

please advise :)

You do not need a copy of your SSN card. 

Add joint tax return transcripts vs returns, add wills etc.  A will would show that you get the home if he passes.  

Any vehicles or vehicle insurance?

Why are you submitting a  marriage certificate?  That's been verified by your previous petition documentation.

You can make a statement that the house is a pre-marital asset.  They do not expect you to change the deed to reflect it as a joint asset.  Plus the cost of doing that would be insane.  A "Last Will & Testament" naming you beneficiary of the house would more than suffice but even that is not necessary.

For those interested, changing the deed is not an exorbitant cost.

It is very easy to do and the cost to record is minimal. In Los Angeles County, the cost is $18.

We did it ourselves, we did not hire an attorney or anything like that.

 

But a letter t USCIS explaining that the house was bought pre-marriage can be enough for USCIS. Each case is different.

Adding the name to the deed will definitely NOT weaken your bona fide case.

Also, USCIS prefers to see IRS Transcripts over photocopies of Tax Returns.

Thanks for the replies 

 

NikLR:  mostly sending that extra stuff for padding.  The ssn was addressed to both of us, so I thought it might be good for evidence.

 

gregcrs2:  sending the marriage certificate for padding, I guess sending it doesn’t hurt.  

I’ll make a note about the residence for them.  Actually the home was bought after we married but I wasn’t in the states when purchased.  Hope that’s not another complication.

 

sddude89:  thanks for the tip!  I will definitely look into that for in nj.  

We did order the transcripts.  After seeing a bunch of posts about that I figure better be safe than sorry.

It doesn't matter if the house was bought before or after - the statement should prevent a RFE for joint tenancy.  

 

I bought our house after we had been married close to two years and lived in America for a year.  I'm the only one on the deed and there is no mortgage.  It wasn't an issue.

 

You look like you have plenty.

For my ROC my cover letter included this explanation: "Soon after (Joanna immigrated) we found our first home, which we closed on at the end of April 2010. (Due to credit concerns Joanna’s name is not on the mortgage, and it was not until after the fact that we realised she could still have been on the deed. We shall rectify this one day, but right now it is not worth the expense.)"

 

The driver's licenses and bank statements etc all showed that we lived at the same address.

 

Quantity over quality is good. They can always request more of a specific thing if they feel it necessary.  For example, for Photos I think I had one page containing nine photos, of us in various places/seasons and with various family members and at family events.
