So a total of 17 months in the usa with 180+ days of overstay but under 365+ days? Yes you had a 3 year ban.  Doubt there is a tourist visa in your future.

Unlikely to be trusted with another B2, but the US would never say no to your $160.

You can always apply, as you stated you do deserve to be treated according to the laws of the land.

 

Now, there's a very, very, very high possibility that you'll be denied.

 

Unless you have an amazingly compelling reason for having overstayed.

 

Remember: the officer will be analyzing what are the odds you will not comply with the terms of your requested visa (such as immigrating, overstaying, performing activities not allowed by that type of visa etc). You already have a history of disobeying the terms of a visa, so that gives precedent.

Yes.. I know.  Did you read my entire statement? If, you have stayed less than 1 year total, including the visa stay that would likely be less than 180 days of overstay.  But  that wasnt the case for the OP anyhow as they clarified

I did, indeed, read your entire statement in which you definitively stated that if you stayed less than a year total there was no ban. There is no way anyone can make that statement, since there was no information provided as to the length of stay that he was granted at the Port of Entry.  It assumes he was granted 6 months upon entry, but as you know, that is  not always the case.  People with less knowledge than you have could be misled by that statement, which is why I clarified.

Thanks.. i know.  But its number of days not months or a year that triggers the ban.

There is no assumption that 6 month stay was granted.  OP stated I-94 for 6 months.

Why can't people say "good luck"? It's his opinion.

About the situation, yes whether he overstayed illegally or not, it's up to the immigration office to decide. I personally believe saying "good luck" simply means that good luck to his application process, NOT  to show support for his illegal overstay.
