Hello....I am bringing my wife to the United States and I know I have to start with the I130. My question is....Do I have to fill out a seperate I130 for her child? If that is the case I would imagine I would pay with two different checks...one for her and one for her child. Can I put all paperwork for both in the same packet? Thanks for any responses. Dgav333

On the instruction page it states:

B. If you are a lawful permanent resident, you may file this form for:

If your relative qualifies under paragraph A(3), A(4) or A(5)above, separate petitions are not required for his or herhusband or wife or unmarried children under 21 years ofage.

If your relative qualifies under paragraph B(2) or B(3)above, separate petitions are not required for his or herunmarried children under 21 years of age.

Yes, you have to send 2xI-130 filled out form (for your wife and her child). Meaning also, 2x$190.00 checks. You can enclosed it in the same Manila envelope, just don't forget to put a separator or anything that will distinguish one from the other. Sending them together is advantageous, because the approval date for both will be the same.

If you are planning to go K-3 straight, you can send her child's I-130 later and/or after they arrive in the US. When applying for AOS, both I-130 approval (mother and child) is needed. You can send the child's I-130 together with the AOS package. More or less, the child's I-130 will be in the approval stage already, since her/his visa is just a derivative visa of the mother.

The above is correct. You may send the child's I-130 now or send it later. I reccomend doing both at the same time. It makes the AOS process faster but there is really no downside to waiting. You have two years to complete the AOS process anyway.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

I filled out 2 I-130's , one for my wife and one for my stepdaughter, sent them both in together, but with only one cashiers check for 380 dollars. After I had sent it I thought I should have split it up into 2 checks. It wasn't a problem because when I received both NOA 1's , the amounts listed were 190 dollars on each NOA.

Island girl is correct. Two I-130's and two $190 fee's. seperate checks is required unless you put both I-130's in the same envelope. The only time you can pay only one fee is when you are submitting the Affidate of Support $70 fee. When this is required later during the visa process you may submit with both applications at the same time. One more point missed earlier and that is the visa for your child like your spouse is for travel within six months. If your child is to follow later than six months then you will want to slow down the process to me te timeline you desire for your child. If your child is coming with you....keep the applications and all the different steps together.
