NEED HELP...

I have my interview yesterday visa officer Denied my IR1 visa n give me a white paper sheet n ask for a New Joint Sponsor.

My wife has continuous job at wal-mart from June 2016 till today. Its her first job n she submit AOS i-864 in May 2017, on her tax returns their annual income was 10k USD. So we use a joint sponsor from our family friend his income was 100k$.

At my Interview yesterday visa officer denied my joint sponsor n ask for a new joint sponsor. I told him that my wife income is sufficient know on her pay stubs that's about 23k$ he said dot show me that and he said do u have her new i-864? i said no then he gave me a refusal letter n mark on that manually the box that mentioned Submit a NEW Joint Sponsor.

Problem is that i hv no joint sponsor at that time :( 

Should my wife wait for the new tax year started i think in January n file a new tax returns n fill AOS i-864 with her latest income. or we must have to send a New Joint Sponsor?????? Please Help US :(

I suggest if your wife has a new and current tax returns, she could submit that along with a new I-864 form and updated W-2s. And if you have a new qualified joint sponsor though your wife's income is now sufficient, don't hesitate to have that person submit his/her own I864 form along with the supporting documents just so the embassy won't have a reason to turn down your case.

thanks for reply. She submitted her AOS in June 2017  we mentioned her income on i-864 according to her income tax returns. yes at that time we attach that joint sponsor with all required supporting documents. because she file her tax returns on April 2017 so that her income was low at that time. But on her pay stubs her recent year income as know december 2017 is sufficient to sponsor me.

on her current tax returns her income is low because she files her tax returns in April 2017 for her last year income. This year tax returns can be filled after January 2018. My question is that either i should submit I-864 with that upcoming tax returns is sufficient or i have to get a New Joint sponsor along with that???

i'm waiting from last five years lolz m used to it.. I just want to make sure if i send her i-864 with her upcoming w2s, paystubs etc without any New Joint sponsor is it enough for them or i have to send the New Joint Sponsor because they only marked New Joint Sponsor on that White paper. :/ Infact i just want to avoid Joint sponsor because we hvnt any :(

If you think you can wait and your wife's sole income will be sufficient, you can do that without a joint sponsor. Anyways, here's a link for the Income poverty guidelines to see if your wife's income will be enough.

Thanks alot dear actually i'm not afraid of income but m just confused that in refusal letter they Checked the box of New Joint Sponsor. If i do solo n after that they can demand New Joint Sponsor or not?? because she has not paid her last all three years returns but only Once of that last year.

They only need the petitioner to submit tax papers for the most recent year. The other two are optional. If what she's making this year is higher than the poverty line then you guys might not need a joint sponsor. Just out of curiosity do you know why the joint sponsor you had was refused? It might not be that important to you now, but maybe it can help others here on VJ.

Even though she's technically making above the poverty line, it's not that much more. A lot of COs will determine that it's not enough, even though technically it is. That's probably why he's saying you need a new joint sponsor. There are cases where NVC will approve an AOS, but then the CO doesn't because they feel it's not enough & require them to get a joint sponsor. So it's possible that's what you need, especially since that's what they checked off. If there's anyway for you to contact them & ask for them to clarify, I would try that.

idk y they rejected that. i asked him twice but vo said its not sufficient then i try to explain him that i have my wife latest pay stubs n employer letter her income is sufficient bcz she has same job from last one n half year but he denied to even see it he gave me a refusal letter n mark that submit a new joint sponsor.
