Unable to Approve Case at Interview

Hello everyone,

 

We finally had our AOS interview on Nov. 30th. It was strange... the officer seemed ill-prepared and might have been new. When she read the oath at the beginning she could barely stop from laughing. She couldn't find the right pages she needed in the file. She didn't ask for ANY documents other than IDs. She read over the questions that are asked on the I-129F (have you ever sold drugs, participated in human trafficking, committed a crime and not been arrested, etc.) and asked him to answer, basically confirming that he did complete the application. Another officer barged in halfway through and interrupted us to ask our officer "If everything was ok" (I had the impression she was referring to a previous interview based on their short conversation, but maybe she was referring to ours?).

 

So after all of this, she explains that she can't approve us at this time because she needs to run the security clearance (?) and organize the file (she claims it was out of order). She hands us a letter that is titled "Notice of Interview Results" and it states that "USCIS is unable to complete your case at this time. Your case is being continued until a final decision can be made." Then lower down it says "Your case is being held for additional review. At this time, USCIS does not require any further information or documents from you." It goes on to say that they might request another interview and a final decision will be mailed once our case is complete.

 

#######! I'm freaking out because our case is so easy and we have followed everything properly. If there was something wrong, wouldn't they have stated it in the meeting? Why leave us in limbo? 

 

Then at the bottom it says "Please allow 120 days before making a status inquiry on your case." !!!!!!!!!!!!!!!! We submitted the I-485 at the end of April. Unbelievable that they could take up to another 120 days to complete the case!! I am afraid to call since they request to not follow up so soon.

 

Am I freaking out for nothing? Has this happened to anyone else? Is this a passive way to say we are denied? A denial would be truly shocking given our circumstances - we have been together for 6.5 years and have a child together!

Nothing unusual here...they just need to run checks and/or get more documents. It's not a sign of anything being wrong with your case.

ugh, sounds like you got the newbie. Hopefully it's just as simple as needing the dosser to be verified by a supervisor. It's annoying though that it has already been 2 weeks and you haven't heard anything yet.

I wouldn't worry too much, as you said you seem to have a solid case!

We had the same today minus the laughing part.  The officer told us that there was a t-file with my wifes A number in the system.  He also said that this was most likely the advance parole paperwork that was approved but did not make it into her file yet.  He said that he needed to physically put that paperwork in the file before he could approve the anything but there was nothing else needed on our end. We were told that the application would be approved once the paperwork came in.  He also did not ask us any questions about our relationship.
