social security card with DHS restriction

My husband went to SSA this week. He has not received the new SS card yet. The letter states it should take two weeks to receive the new card.

Looks like things are much quicker and better in SSA office at Atlanta. We live in Virginia and my letter states I should be receiving the status about whether SSA is able to successfully verify my current immigration status with DHS in four weeks. After they have successfully verified my status with DHS, they would be issuing an updated SS card. The letter however did not specify how long will it take for the new card to arrive.

BTW - her boss is an idiot. The Green Card is the DHS authorization to work, she passes the requirements of the I-9 with it. Sure, get the SS card with the restrictions removed, but know that her boss is dead wrong.

Dr. LHA,

My wife loves your answer. She is having problems with her boss, who also is saying that she can't pay her more an hour, because she's still not authorized (but as you say........she is authorized). Thanks you for your answer. craig

hey Craig,

It sounds like your wife's boss is into some sketchy behavior.

1, he's lying or an idiot about the SS card

2, he's an idiot or up to something shady with the pay

Your wife can either look for another job, or give this guy a hard time. Let me know if you want some links for help in giving him a hard time!

Maybe your wife should take something from the SSA website (or from the office) stating that she IS work authorized to work...even with the wording on her card. For some people, being able to read it in black and white seems to help.

That's right, because people who arn't authorised to work should simply be paid less, right?

No matter what the SSA office says DO NOT DO NOT give up your SSN card until you receive the new one. Say the dog ate it. LOL

When an individual was previously issued an SSN card with “VALID FOR WORK ONLY WITH INS (or DHS) AUTHORIZATION” printed on it and has been granted permanent residency, he or she can apply for a replacement SSN card that reflects the new immigration status.

An alien granted permanent residency status is eligible to be issued an unrestricted SSN card and will retain the originally assigned SSN.

An alien applying for a work-authorized replacement SSN card must present evidence to establish identity and employment authorization.

When requesting an SSN card, the documents presented, as evidence must be either originals or copies certified by the issuing agency. SSA will not accept uncertified or notarized photocopies as evidence.

The documents acceptable as evidence of identity are based on three factors: (1) the applicant’s age, (2) the applicant’s citizenship/alien status, and (3) the relative probative value of documents.

You can find detailed information regarding evidence of identity on the SSA Website at:

http://policy.ssa.gov/poms.nsf/lnx/0100203200#E

Employment Authorization Documents:

-- I-551 (Stamp or card)

Documents that establish lawfully admitted for permanent residence (LAPR)

-- I-551 card

NOTE: Some LAPR aliens have conditional 2-year I-551s (Alien Registration Receipt Card), subject to the limitation that they must apply for removal of the conditional basis 90 days before the second anniversary of the admittance date to the United States. A conditional I-551 is identified by an expiration date 2 years later than the admittance/adjudication date is acceptable proof of permanent residency.

-- Temporary I-551

Temporary evidence of immigrant status is issued for an alien to use

until the permanent I-551 card is received. This may be a stamp in the individual's passport or on the I-94.

RM 00203.410 Evidence of Alien Status for an SSN Card for an Alien Lawfully Admitted for Permanent Residence:

http://policy.ssa.gov/poms.nsf/lnx/0100203410

Form SS-5, “Application for a Social Security Card,” is the appropriate form to request a replacement card.

Form SS-5 can be requested by calling the SSA toll-free number, 1-800-772-1213 or download from the SSA Website at:

http://www.ssa.gov/online/ss-5.html

Complete the Form SS-5 and take it along with the required documents, to the nearest Social Security office.

You can obtain the address and directions to the nearest Social Security office from the Social Security Office Locator, which is available on the Internet at:

http://www.ssa.gov/locator

Normally, an SSN card should be received in the mail within two weeks after the application and document(s) have been received and verified.

When an alien requests an SSN or replacement/corrected SSN card, SSA will verify his or her documents and current status with the appropriate Bureau of the Department of Homeland Security. If the initial verification is not available through the Systematic Alien Verification for Entitlements (SAVE) system, SSA may need to send Form G-845 for manual verification.

Note: For applications submitted after 01/06/2007 SSA offices can submit an additional electronic verification request, that in most cases eliminate the need for a Form G-845 to be sent. The Brooklyn, NY Card Center has on site USCIS verification.

If your status does not verify through the initial SAVE request be sure that the secondary request has been made and return to the SSA office no more than once a week to see if the SSA office has received a response from the secondary verification request. Be sure to take your document whenever going into the SSA office.

All cards are mailed from Social Security Headquarters in Baltimore, Maryland to the postal address provided on the application.

Ok I know this is an old post however the WEALTH of information I quit has is unimaginable.

I quit so if my husband has a Conditional GC then will his SS card still say anything? or will it be unrestriced?

Thanks

As an HR Manager I can't believe all the rubbish that supposedly educated people come out with. The I-9 instructions are on the back of the form!!!! Do they never read them????

BTW, if you are presenting your greencard as ID there is absolutely no requirement to produce a SSN as well. Same goes for an EAD.

You only need to show your SSN if you are using a drivers license as the picture ID. (one from Column A OR one from B and one from C).

Incidentally, when I went to change my SSN for an unrestricted card I had one hell of a time from the b**ch at my local office. She told me only citizens could get unrestricted cards!! When I told her that many of my employees had unrestricted cards she told me they must all be illegal!!!! I had to go home and print off all the stuff from here to prove my point. Thank goodness for VJ
