Help - just starting to wonder if our visa application is pointless!

 

I met my partner in Australia, which is where we are currently living, and have been for a number of years. He is American and we have decided to move to the states, which is why we have applied for the fiance visa. As my partner has been away for 5 years he does not have any American tax returns, proof of income etc. We both have good jobs in Australia and will have some good savings behind us and plenty proof of income in Australia, however I am not sure if this is going to be remotely helpful in completing the affidavit of support.

 

He has started looking at jobs in the US, however he doesn't plan to move until my visa is approved and we can go together.

 

Can anyone give some advice on this? I am reading a lot of things which tell me that our visa might get rejected as a result of this :(

He will need to be up to date with his US tax requirements and you will need to have a co-sponsor in the US, a friend or family member (who is also up to date on tax requirememts) who is willing to give their financial information and sponsor you. 

 

I'd suggest getting married and doing the CR1. Not only can you get married where your friemds/fam are, but the visas are taking roughly the same time length  (maybe a few extra months for CR1) and it will give him time to catch up with his tax obligations. 

 

He needs to prove domicile in the US too, a home, etc. Another option is for him to go back first, do this and get a job there.

I lived outside of the USA from 2012 to 2017 this May. In February I filled all of my previous years tax return for the time I was outside of USA. No penalty or tax owed, it’s really just informational. It shows my income earned in foreign countries and also shows it’s not taxed as long as you are under $95k (close to this but confirm on form). Form 2555

 

Now I’ve already received all my transcripts for those years and my income is captured.

Still need to file taxes for those years and as said before use form 2555 for excluded taxes

an example:

If you are a U.S. citizen or a resident alien of the United States and you live abroad, you are taxed on your worldwide income. However, you may qualify to exclude from income up to an amount of your foreign earnings that is adjusted annually for inflation ($92,900 for 2011, $95,100 for 2012, $97,600 for 2013, $99,200 for 2014 and $100,800 for 2015). In addition, you can exclude or deduct certain foreign housing amounts.

do your taxes and ask for IRS transcripts of the last 3 years needed for immigration / BTW by the time you get to an interview it will be past April 2018 and the 2017 taxes will be needed 

also need US redisency 

this is not all as difficult as it sounds and doable

I have a question, if anyone knows what the right thing to do is. My interview is on the 30th of jan and my fiance just sent me the required documents including the affidavit. However he feels he is going to lose his job in a few days. what happens if im at my interview and he has lost his job?
