Looking for guidance - My fiance is on the Newest Travel Ban...now what?

When he went for his interview in Jan - we were missing some documents that they needed...we are still trying to acquire them - but it's been difficult.  Have you heard anything about the waiver? Did they put you on "Administrative Process"? So do you just have to wait and see now?

Does anyone have an update if their waiver was approved? We're getting closer to our interview. I'd love to know what you put together to submit for hardship.

NOA1: 26 July 2017

NOA2: 2 February 2018

NVC Received: 13 February 2018

NVC Case # Assigned: 22 February 2018

NVC Left: 27 February 2018

Consulate Received: 1 March 2018

Packet 3 Received: 10 March 2018

Packet 3 Sent: 8 October 2018 (we delayed intentionally)

Interview: 31 October 2018

Currently in AP!!! :(

I don't know about the others but my interview is soon too and i wont be preparing anything for my husband. Its a CO who decides whether the applicant is qualified or not. He/ she will review the docs and ask questions. The thing is the Executive order doesnt define what is "hardship" so its hard to understand what to do.

Some people write affidavits but not sure what they put.

The thing is, rejecting a visa will be a hardship on its own coz either you are separated from your spouse or cant live in the US together.

Hope all goes well for all of us

That in itself doesn't count as hardship, you will need a much better reason than "we are separated" to claim hardship.

I guess we can agree to disagree. For me being away from my husband for 10 months was hard as hell. Again its not defined so it will be up to the CO to decide.

My fiance wrote up an affidavit for why he should be considered for a hardship wiaver

....our situation is a little different - he's still living in a refugee camp...

We had to get official documents -ours weren't considered originals - so now we are waiting until we acquire these documents before requesting another interview.... Good luck - please let us know how your interview goes!

We're probably going to delay our interview until after the Supreme Court makes a decision on the travel ban. They hear it in court on 25 April, and hopefully by June they'll have a decision. We have a phone call with our attorney scheduled for later today to discuss options.

Yeah i see what you are saying of course and indeed your case is definitely different. I think there are many variations and none of them are wrong as each of us have a different case anyway and all we can do is pray.

Hun its my husband and he is Syrian. My interview is on March 18.
