I am in a situation where I submitted ROC documents jointly with my wife two months ago. I had a discussion with my wife that we will eventually have to get divorced because the marriage is not working out. We are about to start marriage counselling just to know that we have tried everything. I still have a long wait until ROC adjudication, so I know that if I can transform my current application into I-751 waiver application if we start the process of divorce. However, if after 10 months my wife decides that she wants to start the divorce process(which leaves a few months until adjudication of ROC), and I must refile i-751 with a divorce waiver, does my timeline renew and I wait for another ~18 months? Or am i obligated to finalize divorce in the remaining few months plus 87 days that they give extra? Is it safer to start the divorce process right now or is there no difference? Thank you very much.
