I read this article about a K1 situation

It got me thinking about whether they just had a ceremony or whether they had handed in a marriage license. If they had got married in a Christian church or some other religion and just had a ceremony without handing in a marriage license would it still be classified as married? I mean what about separation of Church and State?

I've read several different articles about their story, and it appears that they had a legally recorded wedding in Hawaii.

FYI` It's not a church and state issue just because a church/religion is involved.

First ammendment basically states:

"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof . . . ."

It was a legally-binding marriage, otherwise I doubt there'd have been a problem. Had there still been a problem, THAT would've been news. This is a ####### situation - but they weren't in trouble because they went the "ceremonial" only route. They actually went and got hitched. Dumb and unfortunate.

It won't matter if you pin it or what......someone always comes on here asking the same question. I kind of get irritated when I hear people trying to make excuses around the K-1 visa. If they want to get married before the visa is approved, REGARDLESS of the excuses why, then they should wait and file the K-3. It's really a no-brainer. Yet, it seems every day someone asks how they can get around the rules of the K-1.

I do feel for them, BTW.

These people obviously did not have VJ!

I don't understand why the woman would leave the U.S. to get a visa. A visa allows you to enter the U.S. Shouldn't she have applied for AOS because is married to a USC?

It stinks for these people. I read the article and remembered my first phone call to USCIS. They told us what we needed to do, K1. We asked if we could elope and they said absolutly not. I'm glad we didn't.

It would depend on the marriage laws of the jurisdiction where the ceremony was performed. In some jurisdictions a ceremony is all it takes. At the other extreme, in some jurisdictions no ceremony of any kind is required to register a marriage.

The article doesn't mention it, but she undoubtedly did apply for adjustment of status. That's where the incorrect entry allowed by CBP must have been discovered.

Lesson #1 from this article should be, don't go to the USCIS for legal advice - go to a lawyer.

Lesson #2 should be, even if you think you have a simple case go to a lawyer anyway for a consultation to review the facts of your case and verify whether or not it really is simple. These people thought they had a simple case, but they did not. And it was all down hill - way, way down hill - from there.

Actually, I think lesson #1 is to read and exercise some common sense.

If you've applied for a visa meant for UNmarried people and then you decide that since your plans might get mucked up, you'd rather just get married anyway, try putting two-and-two together to see if they equal "a problem."
