Exact instructions for dcf

Hi!

 

we will be filing for cr1 (will be ir1 as will be married more than 2 years upon relocation to US) dcf in the U.K. And my parents will co sign. We will have a baby at the time of moving but not yet. 

 

Can someone listnoit  out exactly which forms/evidence needs to go in the packet? I've come across conflicting information regarding which forms are required and not sure what might be outdated at this point. An up to date bullet point list would be super beneficial. If I've missed this on a thread please do let me know (and accept my apologies!) I did look first. 

 

Also, for proof of relationship - for spouse visa to move to the UK I still have all that info (financial info,  marriage certificate, couple photos, 1 screenshot of correspondence per month with date stamp) - just update it with current joint bank/tenancy info?

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

DCF in London specifically asks for no evidence of bonafide relationship to be sent with the petition.

Bonafide marriage evidence   -  what are you providing for evidence? someone else on here has said evidence isn't required for london DCF so now again i'm not sure! last time, we provided correspondence history, plane tickets, birthday/christmas cards etc. would this fall under residency proof - lease/joint bank accounts/utility bills?  
Petitioner birth certificate   -  original or copy?
Petitioner full passport     - original, yes? do they return this shortly?
Petitioner residency proof    - what are you providing for this one that would be in addition to lease/bank/utility info, and their passport/birth certificate?
Beneficiary birth certificate     
Benefitiary residence optional - what would this entail?
Benefitiary full passport        - again assuming full original in date passport?
Marriage cert copy  
Petitioner prior divorce papers

Proof of relationship does vary by country even in general I-130 filings, but more so with DCF.  Living together (or in the same country) is generally more proof than most I-130 applicants have anyway.

We believe that the black and white requirements of USCIS for Form I-130 doesn't varies to any given country unless they issued an edited and updated version of it.   BUT we do understand that the  applicant and petitioner have an option to provide as much proof they want  to prove family relationship without omitting the basic requirement of USCIS in Form I-130 such as: A copy of your marriage certificate (if you are petitioning your spouse which is applicable to you now) ; and or Submit a copy of the child’s birth certificate showing your name and the name of your child.

 

We suggest that you will visit this link:  https://www.uscis.gov/i-130 there is a downloadable Instructions for Form I-130 if you click that site. Once you download the Instructions for Form I-130, Petition for Alien Relative, please browse down to Page 6 (General Requirements), and scan down to number 5 which talks more in detailed about : What documents do you need to prove family relationship?

You have to prove that there is a family relationship between you and the beneficiary. If you are filing for a relative listed below, submit the following documentation to prove the family relationship. A. A spouse: (1) A copy of your marriage certificate; (2) If either you were or your spouse was previously married, submit copies of documents showing that each of the prior marriages was legally terminated; and (3) You must submit two identical color passport-style photographs of yourself and your spouse (if he or she is in the United States) taken within 30 days of filing this petition. The photos must have a white to off-white background, be printed on thin paper with a glossy finish, and be unmounted and unretouched. The i-130 instruction PDF says:

Furthermore, I don't think it is wholly appropriate for someone who has never submitted an I-130 through the London USCIS office, but rather a DCF case in a country that has its own rules (hello CFO anyone?), to be making blanket statements about what is or is not required and claiming it is the same country to country, when it is most definitely not.
