Hi, y'all!

 

I filed an I-130 & ended up in Nebraska ("Where Love Goes to Die").  Our packet looks to be reviewed in the next couple of weeks.

 

I've looked HARD on this site to determine the best course for my wife & her three children (ages 13, 10, 4).  It seems that I should have filed an I-129F to bring her as a fiancee because the "kids are free."

 

Three children at $535/ea. for the IR/CR 1 process?  Is there another 2-year wait for each of them?

 

Should I file an I-129F this weekend?  What would be the result, since the I-130 looks to be evaluated soon?

 

I appreciate this community.  I've lurked for a while now!  Thanks for any help/advice you could offer!

Nothing is free in Immigration land

 

You need to file for your step children if they are also to immigrate.

06/19/2017 -- CSC Received reply

06/26/2017-- Approved 

06/30/2017-- received NOA2

07/10/2017-- NVC Recived case

07/11/2017-- Case number assigned

08/14/2017-- Interview ( APPROVED )

11/29/17- Packet sent to Chicago lockbox ( I-485, I-765, I-131 included)

12/1/2017- recieved packet

12/6/2017 NOA1 text and email recieved

12/8/2017 NOA1 Hard copy recieved

12/26/2017 Biometrics done

03/31/2018 RFE - I-131

04/19/2018 Approved I-765, I-131 ( EAD & AP )

04/26/2018 Received combo card in mail

12/06/2018 Interview done - no decision

Are you married? If so, then an I-129F for a fiancee would not work. And an I-129F for a spouse is the K-3 route, which is obsolete anyway. You can do it still if you really want, but it is NOT cheaper nor faster to get a green card (maybe a couple months faster to enter the US?). And has virtually no chance to actually get through NVC.

Current USCIS policy is to adjudicate an I-129F for  spouse with the I-130.

Current NVC policy is that if an approved I-130 arrives before or at the same time as an approved I-129F, then the I-129F is administratively closed.

 

Now just as a hypothetical cost-comparison:

CR-1/CR-2 route:

4 x $535 (already paid) ... NOTE: if you are a USC filing for a spouse or minor children, then each intending immigrant must be petitioned separately. So this is $535 x 4

4 x medical exams

4 x visa application fees ($325)

1 x AoS fee ($120) - Assumes all cases are processed at once

4 x Immigrant fee ($220)

Total: $4,440 + medical exams

 

K-3 route:

1 x $535 (already paid) for I-130 for spouse

4 x medical exams

4 x visa application fees ($265)

AOS:

1 x $1225 for spouse's I-485

3 x $750 for children's I-485s (+$85 for the eldest as they will likely be 14 by then and need the biometrics fee)

Total: $5,155 + medical exams

You still have time left since you only filed in March. As of right now you still might have 1-2 months for a NOA2 then it will be sent to Manila. 

 

Why would you file an I-129F??? If it's for a K3 visa then give up on that because they are essentially obsolete at this point since only 132 of them were given out across the world(I checked a few weeks back).

Removing the already-paid costs makes it $2,300 remaining for the current path versus $4,620 remaining for the K-3/K-4 path anyway.

ur stepkids each need own I-130 with 3 separate fees.  this is the only way for them to immigrate.  u do not do, then they do not immigrate.

 

nothing is free.  even K-2 cost money.  then there is AOS fee. 

 

nothing is free cuz the system is self supporting from fees.

 

if they get conditional green cards, then there is also ROC fees for each of them.
