student visa denied

Hello everyone! 

 

Yesterday I had my interview to get a f1 visa to study in the USA, even I had all the documents that I needed, my visa was denied because of dection 214(b). 

 

This is my situation: i am from Spain and I was an au pair (j1) in the USA for almost 2 years in San Francisco and I came back on september (3 months ago). I decided to study a certificate in Legal and Community interpretation because I want to specialize on that field. 

 

Yesterday at the interview they didn’t ask me for any document. They only asked me why again San Francisco, if I was working in Spain, how long I have been in Spain after coming back from USA and where I was planning to stay while I was studying (I said in a Student Residence). After that they said mu visa was denied.

 

1. Does anyone know which can be the reason why they deny my visa? I know a lot of au pairs that went back to their country and ask for a f1 visa and they didn’t have problems.

 

2. Do you think I have any possibilities if I aply again for the semester starting in August? Or it is difficult now that I have a denied visa?

214b was the reason you were denied. In other words, the officer wasn't satisfied that you would return home at the end of the study course. He is of the belief that there is more to San Francisco than a study course for you. You look like you are trying to get a job here (because Spanish speakers in Spain don't need legal and community interpreters, it's a job that is done in English-speaking countries). So this is a course that has no purpose in Spain. 

 

You can apply as many times as you like, but without overcoming the reasons for denial you will be denied again.

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Timeline

you needed to provide proof ofacceptance to a school or college for study 

and usually a study visa is done by lawyer of the college or university

if you had no proof of continuing education like letter of admittance then no visa

they accept 

       letter of admittance with start dates

      proof of money sent to hold your place in college

      proof of money sent to hole your place in student housing

Seems an odd choice.

 

I do know something about Spanish law and it is very different to UK and US practice. I know I found it very confusing when looking from an English Common Law, Napoleonic Code background.

Thank you everyone, but on my i20 does not say anything about legal or community interpreting, it only says Translation and Interpretation. I have another friend eho was au pair too in the same situation, maybe is something that has to do eith the fact that we were au pairs before? I want to reaply and have the opportunity to show all my documents.

Don't you think they make inquiries about that the program is about before giving someone a visa?

 

Or are you saying that the program is not about what we said it was about?

Took me 5 seconds to find the details, and I do not do this for a living.

 

Perhaps the CO was as confused as we are.

 

You can apply as often as you like.
