Forgive me if I'm putting this in the wrong place. I know the answers I'm looking for dont exist, but I'm desperate and depressed.

 

I'm American, my girlfriend is Canadian. She lives with her emotionally abusive family (we're both adults) and I have an apartment in the states.

 

I hate the distance. I want to keep her here, but obviously don't want to risk visa fraud (she's just visiting). She doesn't want to go back to that hell hole she has to call home.

 

How risky would it be if we just got married while she's on the tourist visa and she stayed while we applied. Or would it be safer to go the fiance visa route, and send her back or get married in Canada and then apply to bring her here?

 

If your experience / opinion what would be the fastest way to get her in the USA permanently and quickly and legally. Willing to do whatever it takes. Just so sick of waiting.

If you didn't intend to get married and adjust status during this visit, it is not fraud to marry on this trip and adjust. If she came with the idea that she'd stay, then it would be fraud. So the fastest way is to marry now while she's in the states and file to adjust status. She won't be able to work or return to Canada until she gets her EAD and AP.

If she is here now, then I agree, Justice of the Peace and start filing the AOS.  Just keep in mind if you take this route, she cannot reenter the country (if she were to leave) until she either has an AP or GC.

If she's ready to make the leap and stay here now, you can marry and adjust.

Research your options carefully, as others have said before me, she will not be allowed to work or leave the country until she has her EAD card and AP which as of now may take more than 4 months.

11/21/2017 Received biometrics appointment notice scheduled for 11/29

12/15/2017 Interview notice - interview is scheduled for January 19th! Holy #$%^ that's less than 3 months from PD!

01/02/2018 EAD + AP approved

01/16/2018 Combo card delivered

01/19/2018 Interview - recommended for approval

01/22/2018 New card is being produced :dance:
