From what I understand, there may be a way around having employment. You need to be able to show a sustainable amount of assets. Anything that could liquidized like stocks, bonds, 401k, IRAS, etc. Otherwise, I would have a secondary sponsor lined up just in case.

If you don't have employment or "sufficient income" to meet the minimum for your household size, you can alternately show proof that you have enough saved assets to be able to support your beneficiary... If you don't have such assets you can use form I-864A to enlist the support of other household members (including their income as if it was your own for support purposes).  Finally, as suggested above, you can get a co-sponsor where really ANYONE can sign a legally binding contract that says they will make themselves financially responsible for your beneficiary.  This can be a relative, a friend or anyone else who is willing to tie themselves to your beneficiary for up to 10 years of financial obligation.

To clarify (hopefully)

From USCIS - "If You Can’t Meet the Minimum Income Requirements"

If you cannot meet the minimum income requirements using your earned income, you have various options:

  • You may add the cash value of your assets. This includes money in savings accounts, stocks, bonds, and property. To determine the amount of assets required to qualify, subtract your household income from the minimum income requirement (125% of the poverty level for your family size). You must prove the cash value of your assets is worth five times this difference (the amount left over).
    • Exceptions:
      • If the person being sponsored is a spouse, or son/daughter (who is 18 years or older) of a U.S. citizen: The minimum cash value of assets must be three times the difference between the sponsor’s household income and 125% of the federal poverty guide line for the household.
      • If the person being sponsored is an orphan coming to the United States for adoption: The adoptive parents’ assets need to equal or exceed the difference between the household income and 125% of the federal poverty line for the household size.
  • You may count the income and assets of members of your household who are related to you by birth, marriage, or adoption. To use their income you must have listed them as dependents on your most recent federal tax return or they must have lived with you for the last 6 months. They must also complete a Form I-864A, Contract Between Sponsor and Household Member . If the relative you are sponsoring meets these criteria you may include the value of their income and assets, but the immigrant does not need to complete Form I-864A unless he or she has accompanying family members.
  • You may count the assets of the relatives you are sponsoring.

Have you checked with the embassy first? When I looked at mine, it says I would have to wait until the embassy/consulate gives you a letter and you take that to a specific doctor. Same with the police report. You just present the embassy/consulate letter to the police before the issue the certificate.

Just checking if that’s the case for you. Wouldn’t want you to have to go through all this hassle, just to do it again!

Happy Monday!

My embassy is that way too. He can't go for the doctors appointment until the embassy gives him a letter to take to one of the doctors on their list. I think the police letter can be collected prior though,. It must really be embassy by embassy. CHeck your embassy page before you do anything :-)

I’m too organised!! Haha. I already have my police certificate, new passport (as London love the best conditioned passport), tax returns etc. We are so methodical, organised, prepared for the worst, wise but ready.

I know my absolute stunning beautiful half will read this-thanks Jake LOL!! Ready to slay this-no matter whether it’s an RFE or approval!! Goodness, it’s scary as I had a psychic reading done 3 years back and the psychic was chanting USA and id meet a guy my age and spend my life with him-hell I’d never been to the USA at that point and confused as ever!!!!!! Well it did come true two years later as after a Celina Dion concert in Vegas  i met this guy the same age as me who is now the love of my life. Gives me extreme goosebumps writing this as when I had the psychic reading done I’d never been to the USA. And look now?!!!! Can’t wait to see my babe next month!!!

❤️❤️❤️❤️❤️❤️

Ha! maybe you should list that psychics contact info..lol. I need to know when this dang approval will come!!

Hello everyone,

I know Monday can be hard, and we can be a little moody, but we are all in the same journey, so let's relax.

A_R, don't take Naes comment personally. She is really helpful and will always reply to question just with a bit of sarcasm in it.

Happy Monday :)

Hi Vivianna,

Hello !!

Thanks for your advice, I shall keep that in mind though.

It feels nice to be welcomed by some members. the wait can be hard.

Hey there,

We are all here for support as we know the process and appreciate what we are all going through.

I always find it useful to search the toolbar for ideas and opinions- i get that its always nice to seek a few opinions as I’m like that too. But it always nice to be nice-hope I don’t offend you. Some people need few more opinions which is perfectly fine but never underestimate/question the time that people give to reply. Always be mindful how you seek that though.

We paid for a lawyer and to be honest I ask was that the best option-prob not!!

We are all here for support so don’t feel awkward or scared to ask! A forum is designed to ask questions/research. Just be mindful sometimes of wording! Im Irish and so gentle with wording and support as we gotta be here with our history.

Ask away anything your unsure of after researching!! You have that given human right. Some of us know less than others-we are all here for support!!

Best of Irish luck 🍀

Hi jakejon,

Thanks for the sweet support and suggestions.

I totally agree with you that it is always nice to be nice and any time put in by anyone is really sweet - just being snide creates a negative environment somehow, which I don't want at all.

Not to worry nothing to offend here and you don't have to worry with what you say - you have been very kind to me.

We are all here for providing suggestions and opinions.

I find it comforting here to find so many people going through the same thing and providing positive energy to everyone. I know it is hard on everyone.

Thanks again :-)

Best of Indian luck to you !!!

Alright. In regards to vaccinations and things.

What and when to take vaccinations

You need certain vaccinations to immigrate to the United States. The diagram below shows what vaccinations you need at what age. Depending on your country of origin, most people have already gotten these vaccinations. DTP/DTaP/DP does 'expire' after 10 years so most need to have a booster shot for that. So look through the diagram what you need and compare it with the records you have. If you do not have any records of your vaccinations you will most likely need to retake them all. You will get the missing shots at your medical.* However, getting a shot at your medical will be more expensive than getting it at your own physician, especially when needing more/all shots.

Flu shots are only required when flu vaccine is available.

*This is can depend on your country. As far as I heard most if not all countries work this way.

vaccines.jpg.bb29a3f4834de27a5f9b77a1df72141e.jpg

When to schedule the medical

Regarding when to schedule the medical. This is completely dependent on your embassy. Some embassies/medicals don't allow you to make a medical appointment prior to receiving your 'package 3' (all the information you need for the embassy stage). There could be a form or a paper in package 3 that you need to make the appointment. Most medicals however are scheduled based on your NVC number. So technically, when you got your NVC number you could schedule your medical.

But keep in mind that your medical is what determines the validity of your K1 visa. When your medical expires, so does your K1 visa. Most medicals are valid for 6 months, some only 3 months (if there are health issues). So if you make a medical on the 1st of June and don't have your interview until the 1st of august your K1 will only be valid for 4 months in stead or the regular 6. Maybe even 1 months if you have prior health issues. So getting your medical done (too) early is a risk.

Getting a co-sponsor is easier than proving you have sufficient assets as the assets need to be 5x the amount you're missing in income. So lets say you need to have an annual income of 30.000 dollars to support the family and you only make 20.000 a year, then you are missing 10.000 dollars. You will need 10.000 x 5 = 50.000 dollars in assets to prove you can support your fiancé. Most people don't have that.

A Co-sponsor can be anyone, from a relative to a friend. Do keep in mind that when comparing their income to the poverty guidelines you need to count all members of both families. So lets say your dad will sponsor you and his family consists of him, your mom and your sister. And you live with your daughter. And your fiancé is bringing his/her son. Your dad will have to make an annual salary to provide for 7 people.

If you get a Co-sponsor both you and the sponsor need to fill out an affidavit of support for the beneficiary to take to the interview.

I think the police letter can be collected prior though

Depending on your country you can get this prior to receiving the package 3. Often it is even advised to do so. In the Netherlands it can take up to 6 weeks to get the police certificate. So make sure to make a call to your government to see how long it usually takes for you to get that certificate and for how long it is valid. Some are only valid for a few weeks to a few months.

One correction: if you do not have vaccination records, you can get (and should) a titer test. And depending on these results they will determine which vaccinations are needed.

in addition to that, if someone had chicken pox as a child they should tell the doctors verbally.

Guys my timeline went back to 16 JUNE :(

Looks like October is a slow month and there is still a lot to approve. Gosh this waiting for approval is terrible.

How do we keep up the positive with this movement?

It has been jumping back and forth for a while now. It usually goes one down, one up, one down, another one down, one up, one down, another one down and one up again. So overall it's still going down, just fluctuating.

Besides. Its just an estimate. Who knows, you might get your NOA-2 on the 6th of June, or on the 26th. There's really no telling unfortunately.

Don’t worry about the timeline too much. October has bigger number of cases and they are moving forward, it’s just they didn’t catch as many vj members as previous months yet :) that’s why it looks long here on estimations.

especially right at the start of the week is usually bad because it looks like it stopped during weekends and Mondays are slow days.

they will start November soon and a big amount of October will get their approvals during these next two weeks. I’m sure it will improve a bit again ;)

The I-134 (Affidavit Of Support) instructions say this:

Submit in duplicate evidence of income and resources, as appropriate:
A. Statement from an officer of the bank or other financial institutions with deposits, identifying the following details regarding the account:
    (1) Date account opened;
    (2) Total amount deposited for the past year; and
    (3) Present balance.
B. Statement(s) from your employer on business stationery showing:
    (1) Date and nature of employment;
    (2) Salary paid; and
    (3) Whether the position is temporary or permanent.
C. If self-employed:
    (1) Copy of last income tax return filed; or
    (2) Report of commercial rating concern.
D. List containing serial numbers and denominations of bonds and name of record owner(s).

I would think that without employment, it would be difficult to show you have the ability to support your beneficiary.  I'm not an expert, but it seems like you really need to be able to show that you're employed or have means of supporting your beneficiary.

I want to ask a question: Will I the beneficiary need to give Tax clearance, proof of Salary or bank accounts etc for the K1 interview as well?

Nope they don’t care for beneficiary’s finances unless the embassy lets self-sponsorship and beneficiary wants to sponsor themselves.
