yes, I remember you told me about 14-60 days. but I still just hope

I don't think I can start this process again,  if they do not re-open the case, I will be moving there instead.  Another 9-10 months are just to much right now to even consider it.

Has this happened to anyone else, or with Every RFE, did everyone sign them..  I sent in my RFE and I did not sign mine.  They received my papers a week ago Friday, without any signatures on any of extra evidence needed.

I got an RFE on June 20 (the date listed on the website).  Submitted response on July 17 (again the date they acknowledged receipt).  So I guess technically they approved mine 8 days after receiving my response.

 

Case was approved on July 25th.  The RFE required original court records of 2 misdemeanor charges from the 90s.

Getting your NOA2 later than others doesn't always mean you will be getting your visa later as well. Hang on to that thought because that is what matters at the end of the day, isn't it? I got my NOA2 on June 18 (June 15 according to hard copy). Case was only assigned on July 6, and today, more than 2 weeks later, my case is still at NVC. Then it will be one week at least for it to get to my local Consulate after it leaves NVC, and here is catch: in Brazil, they only allow to schedule an interview when case is ready, the earliest date they offer is one month from the date you access their system and they only do K1 interviews on Tuesdays. That means, in short, that August is off the table now. If anything, I'll be lucky to get a date in early or mid September (and then it is two weeks to get passport with visa upon approval - probably no September POE for me either).

 

Why am I telling you this? Because browsing the forums I see people who got their NOA2 many weeks after me, their case arrived in the NVC in 10 days and they were already able to book their medicals and interview. 

 

I have no doubt whatsoever that they will have their visa in hand much before me! 

 

So... who knows? Maybe your NOA2 is taking a little longer to get there but when it does, you will be able to navigate what is left of the journey much faster than you expect! :)

 

Keep your head up and don't lose faith.

Sorry for replying to such an old post, and asking a Brazil specific question here... Just wondering when you get to schedule the interview, is it after NVC approves, or after the Consulate in Rio receives the petition?

I submitted a signed cover letter and I also had to get a notarized statement which I signed (basically an affidavit) since one of the charges was completely expunged and there is no record that can be found now (including no police report).  The RFE letter required the notarized statement in the event court documents were not available.  I was lucky enough to find the original expungement order to include in the response.  Here is what my cover letter looked like:

 

Dear Sir or Madam:

 

Enclosed please find the following supporting documentation for the two misdemeanor arrests I noted in the I-129F, Petition for K-1 Fiancé[e] on Page 9, Part Number 3, Item 4a and 4b:

 

09/1997 – Misdemeanor Arrest for Possession of Marijuana

  • Original Order for Expungement (signed by the Judge and the Clerk of the Circuit Court);
  • Original Certificate of Compliance (signed by the Clerk of the Circuit Court) indicating that all court records of the arrest be expunged;
  • Original Order for Probation from the case, indicating the suspended sentence of 60 days for the charge and six (6) months of probation; and
  • Notarized statement detailing the events that led to the arrest, the arresting agency, the charges filed by the arresting agency, the final disposition of all charges with a list of the charges, the location of the Court and any punishment

 

08/1999 – Misdemeanor Arrest for Possession of Marijuana

  • Judgment and Sentence of charges;
  • Amended Judgement and Sentence of charges; and
  • Arrest and Booking Report (with narrative)

you are lucky! it is very fast. we answered the next day after received letter from uscis. and their question for rfe was not so difficult.

Not a problem! Not many Brazilians have made posts about how exactly they proceed after getting their case number from NVC, so here is what I could gather from the material the Embassy makes available to applicants and from my own research.

 

To schedule an interview, you need to register and create an account no site da CSRA.

 

The only problem is, after you register, to create an appointment you will need to provide your case number (which you will probably get by calling the NVC within 2 weeks of your NOA2). While your case is "AT NVC", the system will not allow you to proceed.

 

I have learnt from other timelines that people are sometimes able to proceed with the booking when their case is in transit, but by then the Consulate will not have your documents yet so I cannot advise you to schedule your interview at this point even though the system will allow you to.

 

I think I will start a thread to see how other Brazilian applicants have proceeded - if they waited for the Consulate to contact them to schedule their interviews, if they didn't, if they had any problems or not. :)

Not sure if all RFE needs to be acknowledged and signed.   Mine read like this, and for the life of me, I have no clue how could I have miss it.   I hope you get approve but I will recommend re-sending the RFE if you made a copy with the signature before they take action on your case if you missed it like me.

 

You failed to answer all the questions of Form I-129.  USCIS cannot complete processing of your request until Part 3, Question 4.a Is answered and your response documented. 

 

4. Have you ever been arrested, cited, charged, indicated, convicted, fined or imprisoned for breaking or violating any law or ordinance in any country, excluding traffic violations (unless alcohol or drug related?
