I answered YES giving the explanation that my current case details – case id, recd date, etc.

 

The correct answer is actually NO.

 

The K1 visa is a non-immigrant visa (with the intent to immigrate). Your current petition does not count.

Timeline

Is it common to have a long wait for the RFE letter? The website states that the it was sent last week on the 12, but I still haven't gotten it in the mail. The inquiry date isn't until August 11 though, so I guess I have some more waiting to do.

My Fiancé just called and got this response.... “Look out in the mail for a letter. Call back on Monday if you don’t get anything.” 

 

Im guessing (hoping/praying) that means they sent an RFE?! But I’m not sure.

Hi everyone can someone please help me with filling up the ds160 form. I have an EB3 immigrant visa applied for me in the year 2015. Is it correct that I will answer YES in this part of the ds160?

1.Has anyone ever filed an immigrant petition on your behalf with the United States Citizenship and Immigration Services?

*** Could a pending eb3 immigrant application affect my k1 visa application ?

Im interested in a similar question my fiance mother who is a green card holder that was received trough  Family based (my fiance sister who is a usc) her mom summited a petition for my fiance i belive it was a few years ago would affect our pending  i-129f petition day 197 for us since noa1 and where would a question like this come up at interview or any future forms

I did call USCIS today and asked. They tried to tell me my case was still in normal processing times and that I had to wait. But after specifically stating, for a second time, that the website said they had sent an RFE, they were able to confirm, and told me I should receive the letter by July 24.

some people who filled in the middle of Jan already got their NOA2

but many people from Dec haven't got it yet

and site shows Dec 22 processing  :blink:

I see you are a newbie Anna, so you might not have been around for long. But this is normal, unfortunately.

There are also still people from November, October and even before that waiting.

USCIS works through a whole month quickly, touching about 50% of all cases, then they go on to the next month. They continue to work on the previous months, but they do move on. Its nothing to worry about. Its normal. Don't worry. Just sit back and relax. Your NOA2 will come.

I received the RFE letter today. In our initial application I mentioned that we met online, but I did not specify which website, that was stupid! They are asking for clarification on that and proof that it is not an international marriage broker. I searched for similar cases and was able to find plenty of help already. I'll be working on that this weekend, and hopefully have my response in the mail by Monday.

That made me look back at my petition to remember what I said.  All I put was my fiance and I met in May 2017 and began corresponding daily.  I didn't even say how we met. I didn't get an RFE
