Question about petioning spouse

Hi Everyone,

 

My mother in law is a permanent resident and has living in the states for 8 years. She would like to petition her husband ( my father in law) who she has been married to for about 30 years. 

 

Does anyone here know if a lawful permanent resident can petition a spouse?  If so, how long does that typically take?  Would it be classified as a CR-1?

of course she can, I'm surprised she has waited so long

 

 

most people file for their spouse as soon as they become a resident. as said, the process take 2 years, category F2A
