Ghana, as stated in the 221g, typically holds on to the petition for around 6 months before sending it back. It will remain in AP during this time.

 

A CR-1 (or any other I-130-based visa) is very different. They are sent back and actually reviewed and either reaffirmed or they send a NOID.

I realized that :)ours was sent back to US and we got a snail mail letter saying it had expired. But others who have filed CR1 who did not have that letter had gotten RFE wanting to know K1 resolution.

Thats our plan a civil wedding. We are no way near keeping up, it just hurts because he tried to do the right thing. I love him and will fight to get him close to me. Hes my world and hes all i got. Everything happens for a reason. I just cant stop the tears from my eyes. 😢

You can try to email the embassy yourself but it pulls a bit more weight if you ask through a senator.
You can have the senator state that it is confusing to you because they kept the documents.
However the CO probably took them and forgot to give them back being unsure if he would approve or refuse the visa.

Yea, i emailed her yesterday requesting that she ask on our behalf. Is so comfusing due to the fact that it was done after the interview

When filing a new CR1 petition after a refused K1 the forms will ask if you ever filed for a petition before and you would enter yes, I-129 and result 
as refused and returned.
USCIS will not have an issue with a previous expired petition not being withdrawn, it's dead already.
Now with Ghana who sits on returns for 6 months USCIS will not know it will be returned yet so I would write a one sentence request in the new
petition
stating : Requesting to withdraw the I-129 previous petition (number/date/name/etc..) due to refusal and return and filing this current 
I-130 petition the same beneficiary. That's it, no separate lengthy withdrawal letter. A short email to the embassy in addition stating you are withdrawing the I-129/K1 and filing for a CR1 if it still has not arrived at NVC/USCIS by the time you are filing a CR1. 
If it has arrived at NVC or USCIS by the time you file again then no withdrawal request is necessary because its obvious in the new forms.

I wrote a 2 page relationship timeline letter in my new petition narrating our relationship from beginning to then current and mentioned that he was refused
the K1 and petition returned and that we were moving forward with this new petition. That was not a withdrawal request but a timeline narration
to paint a picture of our bone fide relationship including visits, events, highlights, etc. I submitted it with my petition to USCIS and it was forwarded 
with everything else to the embassy. 
Furthermore I apologized to my USCIS adjudicator for the enormous 12pound evidence accompanying my new petiton
and explained that the 12# was not good enough
for our then CO and that she did not specify what she wanted and therefore the entire 12# plus was submitted again with the request to make

sure it gets all send to the embassy again.

Thank you much for this information. U have very helpful and also giving me hope. Ill make sure to add all those things when am getting ready to file again. With all the proofs and new proofs we will have, dont think it would be a problem. If is not there by end of March ill write a withdraw letter to the embassy before leaving to ghana. Am also hoping and praying that call him in requesting his passport due to the fact tht they kept some of our evidances. Well, I am very excited abt marrying him even tho😍  we juzt have to play the waiting game for now!

I can't remember seeing one case from Ghana that was not approved the second time around. There may have been but I am watching the Ghana 
forum pretty and reaffirmation thread very closely so I am sure you will be approved the next time around too.

Can i start joining to his name now or wait till we are married (when i return back to the states)? I was going add him on my 401k, second credit card user, health , auto, rental insurance. Regarding the joint account in Ghana is it before or after marriage?

In my honest opinion  do not add to 401k in case something might happen later down the road you may need it.

Depends on what they will accept here with him being in another country most places want to see his legal residence here.
Ask in the reaffirmed in Ghana thread if he can add you now to his account.

Auto insurance is a bit of overkill, he isn't there to drive.
Life insurance is fine as are wills.
CC may not work to add him.
Adding you to his bank account and property ownership would help if that is possible, then use the bank account when there too.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.
