Hello, 

 

I'm desperate for some advice here. 

 

Our situation; 

 

We filed for an Advanced Parole (renewal) 110 days ago and it has still not been approved. We called 7 days ago to ask for a status update and asked if it could be looked at I and we just received an email from USCIS to say that our expedited request has been denied based on no evidence being supplied. We were not given any opportunity to provide evidence over the phone.

 

Separately we are in a process with our lawyers to file for expedited travel and are gathering all the supporting documents. Reason for travel is significant financial loss for a USA company. My wife is an actress and has been cast in a major feature length film that is shooting in Australia. We have letters of support from the production company, casting and film finance ect. 

 

I am now concerned that this initial denial will impact that other process event though we were not given the opportunity to present this evidence. 

 

Separately, as a last ditch effort we also have an appointment at a field office on the morning of the day we are due to travel. December 15th.

 

Can anyone offer any advice as to whether after receiving this initial denial to expedite about how it might impact the other processes we have in place?

A bit confused----didn't you submit evidence/documentation by mail for your 1st expedited request when initially filing the form?  That was your opportunity.

A request for AP expedition being denied does not affect any other pending applications you have.

Thanks so much for your reply. 

 

I was also confused as we never formally applied for the expedited processing. We simply made a call to the USCIS number, asked be be transferred to an immigration officer and then asked that officer if our case could be processed as it was just a renewal. The officer asked for our email address and send we will get an update in 5-7 days. The we receive the email of denial. At no point did the officer ask us to provide any evidence. 

 

So just to clarify, can we make another request for expedited processing / emergency travel even after this one has been denied?

Yes.  Although I don't think you ever formally had a denial, since as you said you never formally requested an expedite....

You need strong evidence to support the need for expedition, though.  Normally they are approved for life + death situations, not work reasons.

Would you consider the email I received from USCIS that includes the following not to be formal denial?:

Although your situation appears serious, you have not provided evidence to support an extreme emergent need, which must meet one of the following criteria: 

*Severe financial loss to company or individual;
*Extreme emergent situation;
*Humanitarian situation;
*Nonprofit status of requesting organization in furtherance of the cultural and social interests of the U.S.;
*U.S. Department of Defense or national interest situation (Note: Request must come from an official U.S. Government entity and state that delay will be detrimental to our Government);
*USCIS error; or
*Compelling interest of U.S. Citizenship and Immigration Services (USCIS).

All expedite requests are reviewed on a case-by-case basis and are granted at the discretion of the Director.

We hope this information is helpful to you and regret any inconvenience this may have caused.

Sounds like your wife is the one that needs to travel not you, who is the USC?

Correct, neither of us are USC, She is a German National in the Green Card Process and I am on an E3 Visa. I do not have the restriction, this relates to her.
