I-864 with I-864a - Number of Copies of Joint Tax Return Transcripts

Hello VJers,

We're getting ready to send in the AOS package for my wife's parents and there are a few questions that came up that we were hoping to get help with.

  • Wife is a USC and is petitioning for both of her parents - IR5 category
  • Wife has no income and is relying on household income (my income, spouse) to meet requirements
  • We file a joint tax return every year
  • She will fill out an I-864 and I will fill out an I-864a

If i'm interpreting this correctly per the instructions, in the AOS package we will need to include two (2) copies of the 2016, 2015, 2014 Tax Return Transcripts - one set of copies for her I-864 and another set of copies for my I-864a, for each of her parents.

Can anyone confirm if this is correct? While we want to save a few trees and feel that it's pretty silly/overkill to include two (2) copies since they are going to be the same exact set of copies, we don't want to risk an RFE/checklist either if we can help it. Thanks in advance!

Regards,

MT

she will need two of everything

they are separate petitions and need to be treated as individual petitions, even if you send them in one envelope

but they are 2 separate petitions, forms, payments and documents for each of them

Hi aleful,

Thanks for your response. We understand we need two copies of everything (one copy for each parent/separate I-130 filing), however we were wondering if we needed two copies of the Tax Return Transcripts for each parent (one copy for the I-864 and another copy for the I-864a) for a total of four (4) Tax Return Transcripts altogether.

Regards,

MT

Were you replying yes to the total of 4 sets of copies of the Tax Return Transcripts?

Let's ask this another way - assuming we were only doing this for only one parent, how many sets of copies of the Tax Return Transcripts would we need?

one i864 and one i864A for a parent

the petitioner always must submit an affidavit of support, and since she has $0 income, you will fill out an i864A as her household member

two parents, 2 affidavits per parent

Hi

I am piggybacking on a similar topic. Filing I864 and I864A for both my parents. I864 by me and I864A by my husband as I am still in school and don't earn.

Question is that in one of the sections on I864 it asks how many immigrants are we sponsoring. Should I mention my dad on my mom's form and vice versa? Because then it says don;t mention any relative on a separate visa petition...

Similarly in I864A it asks how many members are you sponsoring? Should I mention 2 for both my parents or just 1 for that form and make a copy of the form for both my parents?

Appreciate any help!
