Hello Everyone! 

 

I am 33 and she is 30 with a 7 year old son.  They are Colombian.  We have a loving, well documented 5 -year relationship.  We have visited each other dozens of times.  We were planning to get married Spring 2019. 

 

We recently applied for the F-1 Student Visa, we were denied, and they had their B-1 Tourist visas revoked.  We are very excited to be engaged and are feeling very optimistic about our chances when applying for the K-1 and K-2 Visas in January.   

 

Are there a lot of extra forms for the K-2 Visa?   If his Colombian dad is a loser, is that an issue?  I'm fairly certain he needs to sign some kind of special permission.

What types of things do they ask in the K-2 Interview?

From a petition perspective there is no additional work other than identifying the potential K-2 on the form.  When at the Embassy then a separate visa application and fee will be submitted in addition to the K-1.  Most K-2's are not interviewed or even are required to come to the Embassy, but that is an Embassy specific situation.  Most Embassies will require a consent from the birth father whether he is a loser or not

I am in a very similar situation. My I am 39, my fiancé is 30 and her son is almost 10. She is Colombian and the father is also not a very good guy. However, you will need him to sign a petition which will serve as permission for your fiancé for your fiancé to leave the country with her son. You need to start this process now. If he decides to giver the permission, it will need to be notarized and I would recommend taking it to a judge, so that it becomes a court order. Because if he signs the permission for his child and then decides to change his mind, he can keep her form leaving the country with the child unless it is a court order. If he does not sign, then your fiancé will need to get a lawyer in Colombia and get this process started.

 

Finding a competent lawyer in Colombia to handle this kind of thing can be very difficult, we are on our 3rd lawyer in less than a year. We are confident in her abilities, whereas, the other lawyers left a lot to be desired.

 

THE COLOMBIAN FAMILY COURT SYSTEM IS VERY SLOW!!!!!!!!!!

 

Here are the things that we did for my fiancé and her son:

 

*** The following items were notarized and then certified by the Apostille in the Oklahoma Secretary of State Office for official use in Colombia court.

 

- Letter of intent to marry and take care of the child

- Proof of Employment

- Proof of Health Insurance

- Proof of Residence (I got a copy of my deed)

- Proof of Marital Status (I am a widower so I supplied the certificate)

- Proof of Eligibility for school for her son (I also have an 18 year with Academic Scholarship to College...so I included her Scholarships as proof that I value and foster a good environment for learning)

 

 

I hope this helps you.

 

My advice is start the legal process as soon as possible...don't wait!!!
