Tourist visa extention

Hi dear

I hope you know the answer

To extend a tourist visa B1,B2  when you are inside the US, Do we need to hire an attorney to do paperwork  ?or can we do it our self ? what form is it ? Ds 160?  my brother just paid  $2000 to attorney to do this :(((((((

and when is the best time to submit before expiration ??

A lawyer is not needed. But here are some things you should understand.

 

  • The best time to file is well before they are scheduled to leave aka their I94 expiry.
  • You will need compelling evidence on why a person needs to be in the US longer than what they are given. You have to be careful with this. If immigration feels that the foreigner is asking for an extension so they can work, live, or skip the line of waiting for an immigrant visa, they will deny the request faster than you can blink.
  • An extension is not guaranteed. In fact, if the reason is a very good one, he still only holds a 50/50 chance.
  • If the extension is denied, he will have to leave immediately. There is no appealing the decision.
  • If the extension is granted, it will not be extended again. You can't compound extensions.
  • If the extension is granted and he stays then leaves in the allotted time. Prepare for him not to return for a long while. If a person has been in the US for several months on a visitor visa, it is expected that they have no need to return to the states soon after.

B1/B2 is a visit visa. That sounds like a “living” rather than a “visiting” situation.

That is what I was thinking, why would an ethical Lawyer process such an application?

$2000 for a 539 filing? I should've been a lawyer

so ur brother want to live here.   the extension will be deny cuz he no visit.  he living here.  once extension deny, his time pass I-94 is overstay and his visitor visa automatically invalid.

 

bad move.

What is the wife’s status in the US? Why is she not either sponsoring him for a green card, or as a derivative on whatever visa she is on if not a USC or LPR?

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process

his wife came to US as a refugee last year this time, and she supposed to get her green card by next month January, but they told him for another months that is a problem. he doesn't have any place to go since his chines visa expired too, and he is not allowed to go to his county because is one of the banned county so he doesn't have any choice. what is USC or LPR?
