I don't understand how the applications are processed, timelines etc

Timeline

Just wondering if someone can clear up how the applications or processed. I don't understand that timelines on the USCIS website and exactly what happens to my applications once I put it in the mail.

 

 Ok, So my application was sent to the Nebraska service center. (yay :( ). They seem to have a terrible slow processing time. I originally filed for consular processing, but have changed my mind and am submitting AOS today. Anyway, once my AOS is received what processing time lines do I look at. The Nebraska service center? Or my local Field office? My local office shows their processing times as pretty fast. So does my application eventually get sent from the nebraska service center, and is the whole thing (i130 and I 485) then send to my field office? Any idea how fast my application gets sent to my field office? Does my I-130 have to be approved before the rest gets sent to the field office? From what some one told me who also is in my area, once its at my local office it should be pretty quick, but how long does it take to get there? (I know a question easily answered...:huh:)

Ive tried to look up how this all works but its so confusing so if anyone can explain this that would be helpfull

12/06/2017 | AOS package sent (EAD, and AP as well). I decided to do concurrent filing/ AOS instead of consular processing. The lawyer I consulted scared me initially about AOS and that concurrent is more a sure thing, but I already work here in US under TN and did not enter with intent to marry.

12/11/2017 | AOS package received and received NOA1 for them all about a week later

12/30/2017 | Biometrics Appointment letter received 

01/08/2018 | Biometrics Appointment

01/12/2018 | RFE Received. (I forgot to have my husband sign the affidavit of support. Seriously OMG. I looked everything over 20 times.) Mailed the signed page back 01/13/2018.

01/25//2018 | RFE received. Case update says they will now continue reviewing my case. I was worried I would be sent to back of the line because of the RFE, but it didnt because 6 days later it changed to ready to interview!

01/31/2018 | Online- "case is ready to be scheduled!" Yipee!

02/10/2018 Online case update Interview date May 1!!!!

Did you file an I-130? And if so, did you get a priority date in the mail stating the center your case was sent to?

 

If your case is sent to Nebraska, then on the USCIS website, as well as here, you would look at the timeline for Nebraska. It's very rare that the case gets sent to your local office unless you ask for that transfer to happen, and most times its based upon what your reason is.. it has to be a strong and valid reason.

 

My case was sent to Nebraska too and it is the slowest center ever! We got our case expedited through a senators help due to my wife being pregnant, so basically because of that Nebraska approved our case 2 months before they would have ever even looked at it. 

After your case is approved there, it is sent to NVC, where you pay all fees and send in documents required... there it takes up to 11 weeks until you hear about your case being sent to embassy for an interview or not.

Are you doing consulate abroad processing (in the beneficiaries country) or an adjustment of status? In order to do an adjustment of status you must qualify to be able to do that and be inside the United States.

how are you eligible to file adjustment of status inside the US when you were going for consular processing?

 

you haven't stated who is filing for you and if you are in your country, you can't file for adjustment of status, since you have to be physically present in the uS

Sorry, didn't include more info to begin with. I am admitted as a non immigrant under TN status June 2016. Got married in october and my husband submitted 1-130 based on immediate family category (spouse). The application has been received with a Priority date November 6 (when it was received). Initially was going to do consular processing but then changed my mind because I am already here and am eligible to adjust. Adjusting my status would allow me to continue to work when we eventually move if my case has not been processed yet. If we filed for consular processing, then when we move, I wouldn't be allowed to apply for a new job and work as I wouldn't be allowed to apply for a new TN visa because i have an 1-130 pending. I also likely would not be allowed back into the US as a tourist while waiting for an 1-130 (because driving through canada when we move), so I decided to adjust my status and not take that chance. Would at least be able to ged an EAD and advance parole permit. 

 

So I would assume that once they get my 1-485, then my case would not be transferred to the NVC for processing and would eventually get transferred to my local office once my 1-130 get approved? (how ever long that takes....)

no,

 

you should have sent the adjustment of status with the copy of the i130 so they link the case and they don't send it to the nvc, they won't send it back, plus if you didn't send it with a copy of the i130, they'll return the package because there is no approvable i130 in the package

I submitted the AOS 1-485 today and included a copy of the 797 notice of receipt. They should be able to link it with that per the instructions. I am still filing it concurrently this way, I just sent it in separately as I change my mind on the way I am going to do it. Im pretty sure they shouldn't send it back as the notice of receipt is in there. Obviously in retrospect I should have just done it all at once, but I didnt.
