So i'm back here looking for advice, my wife and I have been back in the States for about a year and a half, wife has acclimated and is driving and my stepdaughter should receive her passport sometime in january.

 

Anything specially dealing with Philippine law that we should know before we get started filing the IR-1 for her to join her mother and I in the USA?

Any consent from her father who hasn't seen her since she was maybe a year old needed?

 Anything you guys wanna make me aware of will be greatly appreciated , and thank you in advance.

No consent needed from the father, a mother has sole custody of the child.

Oh and it will be an IR-2 ( 1 is for the spouse ;) ).    

 

Process is the same as what you completed with the I-130 for your wife.

Mother has sole custody of the child, need nothing from the father, whether his name is on the BC or not.

If the father is not in the picture at all even if he is on the BC then the mother has sole custody according to Philippine law. They tend to be very Mother-centric over there in regards to custody issues.  As Hank said your asawa needs to file a I130 for her to come here.

@Joshua@Tinz How is your wife liking the USA so far?

No Doubt about being Mother centric there.

 

I always contributed it to the guy getting so many girls pregnant and running off.  I don't know if it is the cause and effect, or the effect and cause here.  

Just when you think you have TDS eradicate,  a new case shows up.

Not in the Philippines.  The mother gets full custody.

PHILIPPINES ONLY!!!  CFO (Commission on Filipinos Overseas) INFO - Can't leave home without it!

 

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

I do have trouble understanding guys there.  Since there is no divorce it seems like there is no marriage either.  I know dozens of married men and women living with dozens of other married men and women who aren't their spouses.  A few of the men I know have kids with a few women.  It is so strange to me.  My future asawa's sister has been married for 22 years but has not seen or talked to her husband in 18 years.

That amazes me as well about the whole thing. But what is sad is the vast majority of women it happens to are usually pretty poor so it just complicates their situation and puts them further in to poverty.

Asawa doesn't file .. he would.. the child is a step-child  (as long as the child was/is under 18)

She's liking it, she isn't new to traveling so there was no culture shock, we recently moved to northwest GA and shes met a huge filipino community here lots of get togethers and so on.

Yea I knew I would be the one filing, LPR can't petition, Here's the thing though, the child lives with the fathers grandparents, and she/we have been supporting her (them all most likely)  even though the father has  been an OFW all this time, is that really considered "out of the picture?"   I don't think he or his family would be  selfish enough to try and contest her immigrating to the USA, but at times I wonder since that money just "magically" keeps coming in every month. My wife bought the house they live in before we were married as well.

Sure they can, but the wait from filing to interview is about twice as long.
