My husband has two different passports, one from Ukraine(expired, plans on never renewing it.) and the other from Russia. He has always declared the Ukrainian passport each time he has applied for a USA visa. Also he has traveled in the past on his Ukrainian before receiving his Russian passport a few years ago.

 

My issue is in his passports the cyrillic spelling of his name is the same, but the transliterations of his name into English are different. When we got his birth certificate translated last week, the company wrote source language was Russian/Ukrainian. We used the transliteration from Russian to English in all his  documents. Should the Ukrainian transliteration of his name in the "other names used?" If so should I put a note saying that this is a different spelling of his name or something? And possibly attach the bio page of his Ukrainian passport? 

 

He has never put anything in the section asking for other names in past ds-160 since he has only went by his birth name. We also have a joint bank account that's in the Ukrainian transliteration, I would like to send this in with my i-130.

Dec 21st ready for Pick up. Dec 23rd pick up passport with no visa.  Was told due to holidays they resent passport incase Husband needed it, and to return it back on Jan 9th.

Jan 15th, sent off passport back to Embassy, Jan 16th case updated and received passport. 
Jan 24th case touched. Feb 1st sent email asking if they needed anything from us, replied Feb 5th stating still going thru AP, no change on website. Feb 13th, case was touched. March 5th sent email (not by travel docs) asking what we are waiting on, received auto email, unsure if case touched was touch per auto email.
March 5th, 7th case was touched. Also UStraveldocs passport states "There is no status update available for the passport number submitted"

March 15 Sent message via ustraveldocs about what's going on etc etc.
March 19: reply from Embassy Stating we have been approved and should get visa in 1-2 business days! 

March 20th: Issued!!!!! ViH: March 21st.
POE: Aiming for April 26th.

No note needed. In the primary line on the application that asks for his current name put the one he uses now as in his travel

document he will be using, other spellings or alternatives of his name put into the line "other name used" and that's all. Thats how I did. On the yellow package you will receive after the interview  they will list all those names you mentioned.

Did DS-160 ever ask for other names? I don't remember declaring there anything either. I just went with the name spelling that was used in the passport I applied with. I don't think it's misrepresentation. They know it's the same name just translated differently. You are overthinking! I know how it feels though, we have been there too! Do the way I suggested and you won't have any trouble. I'm sure there are lots of people wondering about the same. USCIS know it all.

If you're so concerned, just put the alternate spelling under "other names used" and they will understand. This probably happens all the time, especially since Russia changed its name spelling conventions some years ago.

I disagree. Different transliterations of the same name are not other names. Other names used are official names changed through marriage, court action, etc. You need to present a document for every name change.

 

Consular sections are used to seeing variations of name transliteration. This should not raise concerns.

 

The visa will be issued to the name that matches the travel document. I would make sure the DS-160 matches the passport, and schedule the interview in the name that matches the DS-160.

You may agree or disagree as much as you want. That section that said "other names" exists specifically for that purpose. Whatever different transliteration or variation or country translation or nicknames you used, you write there. Plain and simple. That's how I did. They listed all those names on the yellow envelop afterwards and never asked me for any confirmation of official name change. Some countries don't give you any confirmation. They don't change your name. They just transliterate your name in their own language the way, that makes your original name sound or look beyond recognizable. They might just use  their own equivalent of your original name.

In your case, the consular officer probably recognized that all those names were just different spellings of the same name and did not bother investigating further.

 

If those are in fact different names, additional paperwork is required. At the very least, if there is no other supporting documentation, bring an “Affidavit of One and the Same Person” with you to the interview.

The police certificates also need to bear all the names applicants have used.

Hi,

 

Wife's application to bring her mother to the USA has been processed and USCIS requested REF. My wife was born in Uzbekistan, and she was a Russian citizen and her mother is a Russian citizen for more than 20 years now. So, there are two major issues:

1. My wife's birth certificate )from Uzbekistan was lost and then recovered in 2003 they are asking any other kind of documents that would proof the mother-daughter connection. There is a good chance that she won't be able to find additional documentation, and the DNA test costs about $800, do you guys know how to do the affidavit? Because the paper is saying that prior to submitting the affidavit she has to prove that the additional documentation (School, hospital, religions records) can't be provided. We don't know how to prove it.

 

2. The spelling of her mother's last name in the Uzbek birth certificate (in 2003 they issued a replacement in 3 languages) is let's say Artyomova, while in her mother's Russian passport it's Artemova. The USCIS is requesting evidence of the name change or an affidavit and then letters from two witnesses that this is the same person.

 

Any advice how to tackle these two?

Just throwing an idea there on proving the mother-daughter connection: perhaps a mitochondrial DNA test would be enough, should be about $200.

 

As for the number two question, definitely insist that it is a different spelling of the same name, not a different name; as such there could be no evidence of the name change, would there? Try providing USCIS  with “Affidavit of One and the Same Person,” hopefully that will be sufficient.
