CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

Timeline

I just used these  Top Covered Report Covers. It comes as two pieces, joined by fastener.  First piece -  front, the second one - for the back/bottom". Worked really  great for me  - it "helped" to hold the entire package together   and looked neat. I just took out its "fastener"  because it's not long enough and used ACCO instead. 

Besides, I also wrapped it in a bubble wrap  -  to keep the package safe while it was "traveling" with USPS :)

A link to our package for reference. We used two 2-inch Acco type fastners (available at Staples or Amazon) with two holes punched on the top.

Sure :) Already done with biometric.. We (my son and I) filed in June of this year. 

 

As others have said - the package will get apart anyway, after it's received by USCIS. But my point was  - to keep it safe while on its way to USCIS and make the package look neat.

I shared no t long ago that a friend of my husband worked at the USCIS pretty much checking the packages for family petitions and fiances too and submitting the information into the system. He was there I think was on 2007-2010 something like that. He was the one who told us everything about the K1 Visa and the do's and dont's.

 

He was the one who recommended us the 3 ring binder because it looks neat and way more organize making things easier for the person who receives and review your package. That's how things worked there:

 

  1. You have not less than 50 people per shift (depending on the service center) reviewing the packages. They have a quota to meet per day, something like 12-15 cases or something like that.
  2. A package were all the papers are loose, not even a clip and in not a coherent order makes them waste a lot of time so what do they do? put that aside and keep working on the next one so they can meet that standard quota.
  3. They do get rid of the binder, clips and everything you use to send it but just the fact you make their job easier, makes things easier for us as well
  4. A not organize package also could leads to "fake RFE" meaning getting an RFE over a document you surely did send but they couldn't find it in the mess. In 6 years that I've been a member of VJ I've seen this happening btw.
  5. Even if they papers comes with clips, it makes it really easy to get all crazy and disorganized.
  6. A binder doesn't mean instant approval nor a messy package means and instant rejection, but it will never hurt to go an extra mile, especially with something so important as bringing your significant other to immigrate and move in with you.
  7. So with that being said, of course is not a requirement nor necessary but going the extra mile will never hurt your case.

I did exactly the same thing with all my packages (k1 visa, AoS, ROC and my citizenship last year). Instead of making holes into the paperwork, I used plastic pocket sheets made for binders so the documents remain intact and you can also find the same plastic pockets for pictures and photograph as well, so I had everything in the same package, all labeled.

 

Answer the OP question in our case we put all the Service Center address on the cover, both of our names, k1 visa and my husband's address (he was the petitioner) did the same thing with all 4 packages.

From what I gathered, for us, using the folder with the two-punched holes will hold everything in place and in order - making it easier for the reviewer to find things. Using a table of contents and tabbing the sections at the bottom.

I used dividers for each section of paperwork and then put a big elastic band round the whole lot, with the I-751 form on top.  I didn't hole punch any of it.

I'm from the UK, hubby is from Michigan and is a retired US Army LTC.   We are currently stationed overseas.

My birth certificate had a staple - No problem. And I went for my K1 interview in London.

As for application forms, I noticed that you placed them in plastic slots, did you fold the top of the application forms to punch on the plastic or did you just punch everything?

What are the stickers in green and orange? :P

I'm so skeptical about punching holes on these documents, worrying that they might not accept lol.

Hi Roy&Chanel:

 

We use this dividers with tabs:  https://www.amazon.com/gp/product/B00006IBWN/ref=oh_aui_detailpage_o01_s00?ie=UTF8&psc=1 ,  this item brings 26 dividers with tabs and a cover with table of contents, I only use 18 dividers with 3  ACCO fasteners.

 

The first plastic one contain the check with the $680, we decided put it inside so the check don't get lost and easy to find in the bulk of papers.  And yes I punch all the documents to organize the package.

 

The first 2 stickers in red mark where our original signatures are in the form 1-751, because in the USCIS instructions says clearly that If the form don't have the original signatures they will return the package, so I put the stickers there with the word "signature" in the pages where my husband and I signed the form just for be cautious. 

 

The  third red sticker was for divide the  401 K and the AD & D insurance documents

 

The yellow ones stickers was for mark  all the documents that we have as proof that we lived together in that apartment  when I just got in the US under the K-1 visa and after we got married, because my husband signed the lease of that apartment when he was single.
