You could go live in Morocco while the CR1 is being processed, but as mentioned above, be aware of the financial implications that you will have on him/his family and have a plan for how you will support him and yourself while you are there. And yes you will need to prove US domicile, which can be done through showing tax returns, owning/renting property in the US. I know it's hard being apart, especially if you are married, but you may want to return the US to establish domicile just so it isn't something they can use against you to deny you. 

 

My personal suggestion would be to go to Morocco, get married and live there for 6-9 months (be aware of the 90 day stay rule in Morocco, you will need to leave the country every 90 days or apply for an extended stay) or until you get the NOA2 approval. Then you would return to the US, find employment and housing (unless you have a plan for how to keep these while you are away) and start to prepare for him to arrive in the US. 

 

I honestly think you have a fairly decent shot at the K-1 visa, but it really is just so impossible to say with certainty. The CR1 visa certainly does have higher approval odds, but even CR1s can be denied, though a CR1 denial can be petitioned to be reaffirmed, often leading to an approval. 

 

I think a successful K-1 (and CR1) really comes down to how well you can organize and present your evidence in the initial I-129F packet. Generally couples with a lot of clearly laid out evidence, with photos with family, multiple visits and a clear timeline of the relationship do well. The consular officer who interviews the beneficiary will look at the packet beforehand, and ask questions based on the information found in the packet. The interview does play a part in the approval as well, though some officers seem to be more difficult than others. You have a slight age difference, but not one that I think will be a main focus since you are both within child bearing years.

I am commenting on this now in case someone looks at this conversation again.

 

Domicile depends on the state. For PA, for instance, you maintain domicile there if you show proof that you are intending on moving back to the state and that the other place you are currently living (foreign country included) will not be your permanent home.  For reference: rev-611.pdf

This is only Pennsylvania and I am sure other states handle domicile differently.

The age difference could be an issue, but I've seen larger age differences be approved. It will likely come up during his interview, so just be prepared to have an explanation of your relationship. 

 

Yes, the certified copy of the divorce decree should be ok.

 

My Moroccan husband came here successfully on a K1 in July, so I'm always open to talk about our experience. There are also multiple Facebook groups for women engaged/married to Moroccans where you can find others who can related to you very well.
