Hello everyone ! My time has flown . I have a quick question. My husband’s ROC eligibility starts 12/18. Will it be ok if we file in January although the 90 day grace period begins as indicated above ? If I don’t file by 12/18 (which I know that is not happening ) disqualify us from ROC? Thanks !

One more question ... I am so deconditioned with all of this as it has been so long . So, for the biometrics , I know you include the fee with initial filing but , I don’t recall if he goes ahead and gets the biometrics done and include it with initial filing or if USCIS gave him authorization at a certain point to do it ?! Help I don’t recall the steps . Getting reaclamated lol 😂

Hi E-N, you might want to update your timeline, its still on K-1 Status, I can't see your husband's Conditional PR card expiry. Mine ends on March 29th, my window starts on 29 Dec, and I will probably be sending either first week of Jan or on 29th Dec itself.

Here's the link to the guide: http://www.visajourney.com/content/751guide

Mailing the Packet & What to do While You Wait

The I-751 form and accompanying documents are mailed to either the USCIS California or Vermont Service Centers (click here to see the filing location for your state) depending on your state of residence. (Use certified mail or priority mail with delivery confirmation, and write "Attention: I-751 petition to remove conditions of status" on the envelope under the address.) You will receive a notice of receipt for the form stating that "Your alien card is extended one year - employment and travel authorized". Keep the receipt with your green card. If by some chance you are not approved within a year you will want to make an InfoPass appointment to go to your Local Office to request an I-551 stamp in your passport. This does happen as it sometimes it takes over a year to be approved. After your NOA extension expires, this is your only evidence of legal status which you are required to have, by law. This happens occasionally, that a case takes over a year, but it's rare. Local Offices will not give an I-551 stamp if you have another type of evidence of status (ie, expired Green Card + extension letter).

To make it simpler for you,

File Removal of Conditions I-751 with USD680 > Wait > Notice of Action aka I-797C or RFE > Waits > Biometrics appointment

Good that you actually brought this topic up, I'm planning for a vacation home after getting extension letter, but now I'm worried that I might miss the Biometrics appointment!!!!!!!

Hey there ! I am in the mist of filling things out but yes, where not applicable just place N/A and we are doing it for all spots or placing “none” (as it is indicated in the directions ). They are very picky so, don’t give them a reason to be

Its not a MUST, just extra evidence in case those like me not having my lease as tenant but occupant cos I came on K1 and live right away in our rented apartment. I had no credit score nor visa status, they didnt allow me to and had to use my cousin as a guarantor till my lease was over.
