We finally receive this beautiful email today.

 

"There has been a recent processing action taken on your case.  Receipt Number: WAC1809xxxxxx.  Application type: I751, PETITION TO REMOVE CONDITIONS ON RESIDENCE

Your Case Status: Card/Document Production.

 

On March 12, 2019. we ordered your new card for Receipt Number WAC1809xxxxxx, and will mail it to the address you gave us.  If you move, go to www.uscis.gov/addresschange to give us your new mailing address."

 

So now we await for the letter to interview for N400.

Received an update on our case EAC 18062xxxx and just glad there is some progress at last. We were interviewed prior to our Conditional PR card approval and it was a typical interview.

• Since the initial interview was 3 years ago,  we were wondering if anyone in this December 2017 group called in for the interview? We will be grateful if anyone could share their interview experience. We will do the same afterward.

Overall, a stat in our case number range 1-150 doesn't look promising, out of 150 i-751 ROC cases, so far 5 approved, 49 RFE, 43 pending...

This morning at 7 a.m. California time, I received an update email. I have not received such an email ever until today. The 2/27 date was the date that they sent me a letter regarding reusing my bio data.

Yeah, you’ll get case inactivity notifications about every 2 weeks or so. You can disable them in the settings if you like.

These notifications come from the DHS side of the site.  I disabled ours, but they came back and they are sent every two weeks.  It gets very annoying.

Seems like all of the December California filers getting approved were transferred to another office. Not seeing any movement on those who are still sitting at California and didn't apply for N400.

1. I 751 Submitted on Dec 26, 2017 

2. Got my 18 Month Extension - No Biometrics

3. Applied for N400 Online on Feb 9th, 2019 and Biometrics Completed on Feb 27, 2019

4. Received a Letter Dated Feb27, 2019 for My I 751 stating that they will use the old Biometrics. 

5. N400 Status Says We are actively processing your application as of Feb 27, 2019 and nothing is outstanding at this time.

6. I 751 Status Says Case Transferred to Laguna Niguel CA on June 18, 2018.

I filed Nov 27.  EAC 18061XXXX, it is still in local office and not touched since April 9, 2018.  I did file N-400 and that may be reason, they did not touch my case.  All the cases around me are approved.  It seems you will get comb interview, if you applied N-400

No, did not apply for the N-400 to avoid any delay on I-751 case because as of a current processing time stands, N-400 adds another 12 months delay to the whole thing in my opinion. Also, cases are moving faster after the new memo from USCIS. Ref link:

" Generally, conditional permanent residents who file a Form I-751 must appear for an interview. However, USCIS officers may consider waiving an interview if they are satisfied that:

• They can make a decision based on the record because it contains sufficient evidence about the bona fides of the marriage and that the marriage was not entered into for the purpose of evading the immigration laws of the United States;

• For I-751 cases received on/after December 10, 2018, USCIS has previously interviewed the I-751 principal petitioner (for example, for a Form I-485 or Form I-130); - should have made it apply all!!!

• There is no indication of fraud or misrepresentation on the Form I-751 or the supporting documentation; and

• There are no complex facts or issues that require an interview to resolve questions or concerns. When determining whether to waive an interview, the considerations listed above apply regardless of whether the Form I-751 is filed as a joint petition or as a waiver of the joint filing requirement. Cases involving fraud or national security concerns must be referred to the Fraud Detection and National Security Directorate according to local procedures."

Applying for N-400 does not necessarily delay your I-751 adjudication.  The deciding factors are (1) how fast your local office is processing Form N-400 and (2) how early you filed your I-751 within your 90-day window.

 

The new memo by USCIS actually does not speed up the case processing for us.  The memo does not even apply to us at all because it only applies to all I-751 received on or after December 10, 2018.  People on this thread filed far before that.

 

The memo does not really change what the 2005 Policy Memorandum (PM) suggests.  The 2005 PM issued by the Bush Administration was primarily to address I-751 backlog.  The main difference is that this new 2018 Policy Memorandum issued by the Trump Administration addresses specifically the interview requirement that I-751 must go through the interview (that was not encouraged under the 2005 PM) if the petitioner has not yet been interviewed during the AOS process.  The new 2018 PM only affects those coming in on a K-1 visa primarily because these K-1 spouse generally received an interview waiver once they arrived in the US and filed I-485.  So they are to expect an interview for I-751.

 

On a separate memorandum the Trump Administration also issued is to expand interview for ALL I-485 marriage-based and the majority of I-485 employment-based.  Therefore this specific I-751 interview requirement will be short lived as ALL I-485 marriage-based (including K-1) has now been called for an interview.  Logically then, no one who subsequently file for I-751 will have NOT been interviewed previously.  Therefore, any I-751 (after probably late 2019) will go back to all be eligible for interview waiver, provided that evidence is sufficiently submitted.
