I'm pulling my hair out wondering what the hell to do. I'm working all hours the day gives me, putting all I can away. Not handed in my notice yet either.

Dealt with enough delays already. I should be an early May filer. 😿

 

What do we do now? Is this where we ask someone else to sponsor me? Or will his method of income be sufficient?

That's a tough one, won't lie!

 

If/when they do a background check on your fiance and his SS card shows "laid off" it is grounds for them to deny you a visa. 

 

You mayyyyy have to start the process again with a co-sponsor if it gets to that.

 

OR they could just pass by it and not give it a second thought...

 

But I think the financial part comes after, during the NOA2 part, so if he gets a job by then he should be okay...technically.

My understanding is they wouldn't deny you, they just would give you a timeline in which to find a sponsor.

Maybe.


But it is a deniable reason.


Either way,  he'd either need to find a job or you will have to be proactive and let USCIS know about the change in circumstance.

 

They will let you know what the next steps would be, if any.

  am also curious about something similar because I am suspended from work for 90 days, I still have my employment I am just on a suspension so what do I do in that case does anyone know?

I'm still questioning how they are going to hand my change in employment while I have been waiting for a response since its technically now going to NOT match since I changed jobs in October... but according to the time of app, my employment info was correct... .sooo..... yea...

I’m sorry but where did you get this information, just out of curiosity. I thought examining the petitioner’s finances will be done during the interview with the consulate. The USCIS will assess the application itself and NVC will do the criminal background check.

you should be ok as long as you still make enough to cover your fiancee and family.  You will most likely need to bring information with you to the embassy or have that information if question arises why employment changed.    it is the same for all paper you submit, or submitted, if there are changes you need to state why there were changes.  The interviewer will most likely question why your (USC)  job changed.

IF BEFORE NOA#2:

You must write a letter and send it to the service center where your packet is located. I found it very difficult to find the address, and the main USCIS telephone number DOES NOT have these addresses. Just do a search for "TSC address"... Remember that there are two addresses... One for courriers and one for united states postal service.

The Letter needs to include the following:

1. THE REASON you are writing the letter

2. The full names and date of births of both the petitioner and beneficiary

3. The receipt # from your NOA#1

4. Updated address for the beneficiary

AND THEN WRAP THAT ALL UP AND SEND IT CERTIFIED MAIL

IF AFTER NOA#2:

Then your packet is likely on its way to the National Visa Center, prior to being mailed out to your beneficiary. I have read that if you are already here at this step, your beneficiary needs to go to the US EMBASSY in Colombia and update her address with the local office.

IF THE PACKAGE completes at the NVC stage, your local embassy will send the packet to the wrong/incorrect address. ( which why you need to go update it at the local embassy office )

NOTE:

Calling the National USCIS hotline wont do any good unfortunately. I called 3 times, and 2 of the 3 representatives I talked to mentioned the list above for changing address. I spent 30 minutes on the phone even talking with a supervisor because nobody knew the addresses of the service centers. Finally the supervisor put me on hold for another 30 minutes before coming back on the phone and saying sorry, I we just dont keep that information. At which time I found the address on another immigration forum.

I (the beneficiary) recently moved myself...I don't know how, but I completely forgot about telling the CSC about it.

 

A big thank-you for posting this information!! I sent an email to my fiance so that he can fire off a certified letter ASAP.  We are still waiting for our NOA2...maybe this is one instance where this delay comes in handy!!

From what I've read the K1 visa DOES have a financial aspect to it and the petitioner does need to meet the requirements.

 

They do background checks at USCIS level and NVC (why else do you need a police certificate with you at the interview) as well.


The financial aspect is checked at the interview with the taxes and letter of employment, etc etc...whatever is asked by the embassy.

 

My fiance hasn't submitted any taxes or financial information because I know this will come up at the interview.

 

An approval at the NOA2 is not a visa.

 

People can get denied on the grounds of financial reasons even after an NOA2.

this is awesome, and I appreciate the help, however from what I read, it doesn't explain whether or not an RFE could be issued due to inability to verify employment based on what is on the g 325.....  this is what I'm concerned about.  and RFE for such thing
